Selling on a debt

Can a debt that has been sold to another party be defaulted by that party even though the original agreement wasnt with them ???

    Yes. An account can only be defaulted once though.
  • Ok ! So the company that chased me for the debt took me to court but before we got to that stage I asked for all oringinal paperwork which they could not provide. Their solicitors sent me a letter with a Notice of Discontinuance.
    This debt is really old but I have just checked my credit file and the default has been registered this month.
    The reason I asked this is because I went through the same process with the same firm 3years ago and that fault on my file ends in December.
  • The DCA has to apply the default with the same date as per the original agreement

  • sorry to ask so my questions but I am confused with who to contact to sort this out.
    So the date that should have been put on my credit file is the original date that I signed up to the card or is it the date that the DCA started to chase me ? Cause I will ring them but need to have the correct info x
  • The default date the DCA should be applying is the date that you defaulted on with the original creditor/lender

    can you appeal the default date with the CRA ( Credit Reference Agency )

    Too many TLAs ( Three Letter Acronyms ! )
  • No, you appeal it with whomever has applied it, if you feel it is incorrect (and can provide some form of evidence to prove it)
  • The company who has put the default on my credit file is the company that the credit card people sold it to. The date it starts on my credit file is 8th Oct 2019 but I took this card out ages ago. Surely the date is incorrect. so shall I call the company on the credit file or the DCA ???
