Sick Pay

I have had bad feet all my life and am in great pain. As a result of extra bones in my feet I have acquired bunions not normal ones they actually look part of my feet and are not nobbly. lol I can hear you all laughing already.

Seriously they keep me awake and I have got my op date through. My employee contract says that I can have 14 days per annum sick pay and then another 14 at half pay. I have had 4 days off this year due to flu.

The operation is on a Monday and I will need at least two weeks off to recover.

I want to know if this is considered being off sick as I know about it in advance and whether therefore I should be able to receive sick pay off my employer. I warned them 10 months ago about this but before I tell them of the actual date I want some advice from you clever people.
All my views are just that and do not constitute legal advice in any way, shape or form.£2.00 savers club - £20.00 saved and banked (got a £2.00 pig and not counted the rest)Joined Store Cupboard Challenge]

It looks like your contract does exactly what it says on the tin - 14 days at full pay (of which you've already taken 5), and 14 days at half pay. It doesn't matter what the condition is, it's all classed as "absence". You could take some out of your annual leave, but this would possibly have to be agreed.

If you have an understanding boss, and if your record is otherwise good, you may twist their arm to continue paying you. But don't bank on it and if they do, consider it a huge bonus.

Good luck with the op. It sounds quite uncomfortable.

And actually, that's not a great sick pay scheme is it?

    I agree with spendaholic.

I can really sympathise with you and your feet. I have been having tests for 18 months now after having painful feet for years. I have had a really good result from some injections this week and although I still have some discomfort for the first time if ages I can walk downstairs properly. I hadn't realised how used to being in pain I was until I got some relief from it.
  • I would agree with the first post.

It depends on how 'policy' strict your company is. Often when it is a particular illness and not a lot of sickdays accumulated bosses have the power of discretion.

If this isn't so, try and work out a way to make up the time over a 6 month period on your return, in order to avoid any unpaid periods.

    Hope the op goes well
