can any 1 tell me who is at fault when a customer gives 4 week advance notice to cancelled a DD to natwest bank online and the merchant via phone call and a new DD set up for a smaller amount and later date letter from them dated weeks before to confirm the new DD but the dd still goes out on the old date and amount and this in turn causes the bank account to go overdrawn also is the DD guarantee statement incorrect it says, if a error is made by the bank or company the customer is entitled to a full and immediate refund? natwest have told me this is not correct or legal its not they fault and any charges the bank makes have to be reclimed from the company the company say its natwest fault nothing to do with them were do i stand

You may wish to improve the grammar in your post as it is a difficult read.
If my understanding is correct, this is the series of events:
1 - you cancelled the mandate
2 - a new mandate was set up and you were informed of a different amount and a different date
3 - the original larger amount and date were used. Not the new amount/date.
If so, then the guarantee scheme should see the bank refund the amount.
Do note, that if you owe the money to the originator then using the guarantee scheme can put in you in arrears with the originator which could lead to charges.
What has the originator said about collecting this higher amount? i.e. what are they doing with the money? ( e.g. if its a utility, are they just putting it against your bill. or its a loan that closed, are they returnign the money)0 -
As a above some details as to who the DD is to will help. As some companies are in arrears.
Well a DD is claimed by the company. So I would first speak to them as to why they have taken the larger amount. Before taking any action with the bank.
Or it could leave you with a bounced DD charge from the company.Life in the slow lane0
