DIARY - Link Financial - Car & Barclaycard TOTAL £9400 outstanding

Well, Hello to everyone hope you can help me with this

Please bear in mind im not on the electoral roll and I have never had my name down on a property and im 22, and that I was working for a period of 3 months when I took the car on HP then I was not working and on £45 a week JSA, when I had the car I was stupid and had it with no insurance and no license.

1st, The Car outstanding debt £8000

Well I got a car on finance at the end of 2004, after about 5 months of paying the finance I came out of work, then I moved and didn’t let them know my new address being worried they would come chasing me for the money.

I taxed the car in October 2006

Now back in September last year (2006) I came out one morning at about 10am of my new address and the car was gone, im not on the electoral roll, never have been. The person living opposite me at the time said she see a transporter taking the vehicle at about 7am, so I though damn the finance people had found it and taken it.

I heard nothing until this September requesting that the car needs to be retaxed, and I thought well if the finance people had taken it surely they would of sold the car on to another person to try and reclaim some of there money.

So this month I called them in my lunch break at work (from my work phone silly I know) to check and see why I was still getting letters from the DVLA stating that it should be taxed, they answered and said we haven’t taken or repossessed the car. So im thinking well it must be stolen then, I called the police and reported the car as stolen, they did nothing but give me a crime ref number.

Now this week I was at work and my colleague comes over tome and says I have got a customer on hold, she transfers them through and I say my name and how can I help you then they say is this **** I say yes they I hear them say "im calling from Link Financial regarding an outstanding debt, and I gave them an alternative number (mobile) and as I didn’t want to make a scene at my new job as I have people sat around me on the phones as well, I gave them a C/O address so they could send out "a letter" about the debt owed. as if I hung up on them I was worried they would call back again and my work would get suspicious and fed up of people calling me there, the girl that answered the phone must of provided them the address of the company as well as she has thought it was a customer and they have asked her as he read the address out to me over the phone. so on my lunch break they called me and they said to me what I owe that I need to pay the full amount in 15 days, and I said to the bloke "you must be joking" he even said to "me have I got any family and friends that could help me out and I said to him for £8000 no way".

Now I got the feeling that they are going to be calling me everyday, and I don’t know what to say to them as there is no way im going to be able to pay this money as I am only in a temporary job which could end within the next 5 weeks.

So where do I stand,

Have I any rights regarding the car isn’t in my possession no more, or regarding me being out of work in the near future?

Can I stop them from calling my work to get hold of me, as I don’t want them finding out?

Can they turn up at my workplace in person?

The c/o address, can they seize goods which are not mine?

If I have no income which maybe in the next 5 weeks then what will happen?

I WILL TREAT THIS THREAD AS A DIARY AND KEEP EVERONE UPDATED TO WHAT GOES ON WITH ANY ADVICE PROVIDED

PS. I know I may get the odd response saying its my own fault no insurance etc, but I did a couple of silly things when I was younger and just after some good advice on how to clear it up

I had it when I was 18, as I did being young and immature went out over a period of time and spent upto my £680 credit limit, the rest is charges, came out of work and was young and thought I would forget about it, they cant do nothing to me etc etc, grown up now want to sort it out im only a year and a half of the 6 year thing is there any way I can stall, I would pay it but I can really not afford to. as I don’t know if im out of work soon or not, im temping

  • Can I ask how you can tax a car with no insurance? You cannot, they will not issue a tax disk with no valid insurance document.

  • i had called a car insurance company and obtained a cover note and then canceled the dd and policy and then used the cover note, i know this is a wrong thing to of done, and i have done this post so i can get it all sorted out now
  • please can someone give me some advice as i have got debt people ringing me everyday about this and getting worried, thank you

    We'll need your full SOA before we can offer any advice. check out MSE andreas sticky at the top of the first page. read the bit for new posters.

    get advice from a variety of sources (CAB etc) as well here. You can write to Link financial and say that all further communication MUST be in writing and any telephone calls via your employer will consitute harrassment.

    I doubt that you'll qualify for the six year statute barred ruling (the debt is only 3 years old) so I think you have to resign yourself to having to pay off the debt!

  • What are the monthly payments for the credit card? As for the car, are they requesting repayment of the entire amount in one payment, or are monthly payments still and option, and how much would they be?

  • Incoming £842 a month
    (i have been at my job for about 6 weeks and as im temping this could end at any time it is a 3 month contract and they dont keep the temps on either so 6 weeks to go) then i will be on £46 a week JSA so i might be on £184 a month until i find another job

    Outgoings a month

    Rent £120
    Work Travelling there and back £55 (give a mate money towards petrol)
    Cigerettes £80
    Wine £45
    Mobile £25
    Subsidised Luch @ work £48 (£2 a day)
    Broadband £14

    Total £279
  • They are requesting for both of the amounts to be paid in full within 15 days (now 12 days)

    First, you should contact the Citizens Advice Bureaufollowing that link will take you to their website, which has a section "Find your local CAB"

    A number of people have posted sample letters which will stop debtors calling you at work or home or both. There are also a number of threads that deal with "statue barred" debts (those over 6 years old).

  • Today i have sent them a letter from the template to stop calling me and to send communications via letter, should i send them the template aswell for proof of cca at the same time or leave it a while as im trying to delay it
