Case Thrown Out chances?

  • Hello,

Company name is LEO'S MOTORS (UK) LTD Company number 08980678 - from my first initial research the original owner has already been struck off the gazette for the exact same thing, he then used his wife's name to open this place up. the other person who works with them was also struck off for the same thing too, this been a family business they are pretty used to court.

When I first made my claim I was contacted by another buyer via review site who had the exact same issue, we then looked at other review sites and the regret really sank in then!!

The other buyer told me the case was thrown out straight away but I had a different court who decided it needed a hearing! not to mention that the court lost my file for 2 months oh well!!

Just last week they texted me to say they pay me before it reaches court and that they fell on hard times. I feel like I'm dealing with someone who is insane

I hate to be the bearer of bad news, but they are stringing you along. Even if you win at court they will never pay you as they will simply disolve the company and open up a new one.Their track history speaks volumes.

Please really consider before you throw away more money.
  • Hello.

Thanks, I have already paid the fee's I guess we will be biting the bullet we sort of already expected not to be paid so we sort think we got nothing to lose, the only hope I see here is that they have a stock loan system in place against Leo's Motor's Ltd they have this on their house I don't think they can dissolve the company without clearing the finance?

Are you just hoping for the best here? These rogue traders tend to know what they are doing when it comes to getting away with this as they are well practised in it.

They move the assets to a new company and just start again until the next debts start to build up.

Unfortunately the system is to easy to manipulate and they know how to do it.
  • Hello,

Well yeah, I guess I am because they only want me to drop the case.

They have said that I am Vexatious litigation, I checked it a few times and it confused me because I thought that was if I made a habit of doing this?

Can they really get away with keeping the car and the money? isn't that just theft in end?

Woooooaaaahhh, So they have your car as well?
Either i've totally missed it, even after reading it back, or this is the first time you've mentioned this.
  • Yes, they were given the car back when we submitted the rejection letter.

We got this car on 18th December and Return it on 22nd December,

I recall registering it for tax in December and then getting the tax cancelled by January, I have looked up the car SB60 FXW and it was registered for tax again in April 2019 so I can only assume they sold the car on.

Why have you only just mentioned this?
How did you pay for the vehicle?
  • Hello

I did mention that we rejected the car and they took responsibility via email and verbally when we dropped the car off they promised us there and then,

We paid via bank transfer 2 deposits I also have an invoice I sent to court.

    Thanks

All this sounds like a thread that was on MSE a few months or more ago and more or less the same situation but this thread is from a new member so maybe this OP is the same as the old thread member.

I will try and have a search to check this out.

The OP should of mentioned not having the car at the start as the replies would have been different.
