Blackhorse challenge ppi

Hi I'm hoping someone can help me
I took out a loan in 2006 -2008 was most definitely mis sold ppi I have paperwork showing that I turned it down but yet still put on. In june 2019 I sent off paperwork to claim it back, blackhorse have come back saying they contacted me in 2013 to advise me to claim then & as it's now over the 6 years it's too late. I have contacted them to explain at that point (2013) I had moved from that property 5yrs ago. They are now saying it could take a very long time & I'd be safer going to ombudsman.
I also had another claim with them which they paid out with extra unfair relationship created money they are offering for the loan I am now challenging, they ate advising I cash it but I'm afraid if I do it's me excepting that money of both loans
Are they trying to blind side me please help

    Accepting plevin payouts but referring the case to the FOS is not a problem. Plevin is a separate issue from your complaint and black and white on the outcome. That bit isnt in dispute. You are disputing the missale allegation.

    No. Not really sure how you can think that either as it is they who have told you to go to the FOS.

    For reference, the time bar would be valid if you were at the same address or if the loan was still open in 2013 and you failed to tell them the correct address. If the address was different and you had no current relationship with them in 2013, then the FOS would usually overrule the time-bar. They are telling you to go to the FOS as you only have 6 months to refer your case to them.

    How does the paperwork show you declined the insurance?
  • On my paperwork it shows in the advisors writing that we told them we already had insurance & the advisor didn't circle the yes or no on the question if we want it

    The reason is largely irrelevant at the moment as BH have time-barred it. They havent looked at the complaint reason as the time bar doesn't require them to. You want the FOS to overrule the time bar so the complaint is looked at.

    Regardless, there would be little point in spending time attempting to overturn the time-bar if the complaint reasons were overly weak or invalid.
