EGG taking me to court !!!!! Helppppp

Has anyone been through this??? I am on a DMP with the cccs since april Egg seemed ok at first but now want to take me to court which is next week. I am so scared I do not know what to expect and I have to take my baby with me as I have no one to look after her. I owe them £25k I just dont know what questions they are going to throw at me!!!! I feel so sick.

    I am afraid I don't have anything constructive to offer on this one but just wanted to say good luck, and remember that if you are making an effort to pay, which you are through CCCS, then the judge should look at that in your favour.

    They can't take what you don't have.

  • Contact CCCS for advice. You are paying them under an agreement and the judge will see that.

    Try and find someone to watch the baby for a while as I imagine going to court would be a bit stressful for you as you will be thinking about what to say and the baby will be needing your attention.

    CCCS will know what to say and do and what paperwork you will need.

    Good luck, I hope it goes well for you. If CCCS are able to have you on Debt Management I'm sure the judge will see that as a real effort to repay the debt.

    Egg have taken me to court twice, despite being on a DMP and making regular payments.

    As already advised, speak to CCCs who will do some of the work for you and advise you what to do/say.

    Its really not as scary as it seems. Honest.

    I had to attend Croydon County Court. The first time, It was such an anti-climax after the many sleepless nights I had in the run up to the day.

    I turned up, reported to a bored clerk. Sat in a room with lots of petty criminals and soon to be divorcees etc etc.

    When I was called in, it was not into a 'court' but a small office with a judge sitting behind a desk.

    I explained my situation, showed her my DMP and Income & Expenditure sheet, told her I was with Payplan, which she knew all about and the court judgement was that, yes, I did owe the money outstanding (not disputed by me) and that I should continue making payments through the DMP at the same rate I had ben doing before the hearing.

    The second time (for a separate debt), I did not have to attend initially, it was done by post. The judgement said I had to pay back the full amount (this is fairly standard). I appealed this, as explained on the form. They moved the case to my local court, Croydon again. And again, the same as the first hearing - a three minute hearing in which it was judged I would pay the DMP amount.

    SO, try not to stress, speak to CCCS and don't be scared - the courts see this hundreds of times every day, it's routine to them and they are not intimidating, loads of us have been there!

  • Thank you so much for all your replies. I feel alot better now. It's hard to cope with when only my husband knows and you can't talk to everyone about it.

    Hi scared hope everything goes well tomorrow and Im glad you are feeling alot better about it now. Excellent advice from orpheus. I think it will be pretty routine, but its still nerve racking all the same. I hope you can find someone to look after your baby girl too. GOOD LUCK and let us know what the out come is.

    Hi scared - I think that orpheus has confirmed what is most likely to happen.
    Once a judge sees that you are on a DMP, especially with a reputable charity like CCCS, he will see that you are serious about your debts and is most unlikely to 'order' you to pay any more than the payment suggested by CCCS.
    The good thing about Egg' taking you to court is that they will be just as bound by any Court Order as you will be, and can no longer harrass you for any increased payment.

  • Just another confirmation to put your mind at rest.

    There isn't a judge in the land who would make you pay more than you can afford. You are doing everything right in being with the CCCS and in a DMP.

    Why Egg even bother I have no idea! It's probably scare tactics to try and get more out of you. Barstewards. :rolleyes:

    You'll be absolutely fine but good luck anyway. :)
