Wrong PCN contravention code issued (62)

Hi all,

I was issued a Penalty Charge Notice for "parking with one or more wheels on or over the pathway" (contravention 62) outside my home in Haringey, NL. While this is true, there is no signage to say that this is prohibited. Also, the entire street does exactly the same without penalty, and if we don't the carriageway will be blocked.

Now, I was parked in front of a private gate where there is signage that says not to do so. But, not only is this gate part of the property owned by my landlord, but the council don't have the right to issue a ticket for parking in front of a private gate. So essentially I reckon the parking warden was issuing any contravention they could kind of justify because they didn't have the power to issue one for what had actually occurred.

How do I go about challenging this?

    Dear Sir/Madame,

    I am writing to formally challenge the above Penalty Charge Notice.

    On 26/09/2019 my vehicle XXXX XXX was issued with a Penalty Charge Notice for the reason of being parked with one or more wheels on or over a footpath or any part of the road other than the carriageway. My vehicle was parked on XXXXX Road, where parking bays extend over the footpath and are clearly marked as such. The entire street has cars parked over the footpath on both sides of the road without penalty, as parking entirely on the carriageway would block through access. Furthermore, there is no signage visible on the street that prohibits this.

    For this reason, I look forward to receiving notification that the Penalty Charge Notice has been cancelled within 28 days.

    If this is a council issued penalty charge, we major on private parking tickets here, PePiPoo will be your best bet for council tickets. Register there (but please note that a hotmail address won't work - try using a throwaway gmail account instead if you do have trouble registering) and post a new thread; here's your link:

    Have a read through some of the other threads there before you post your own to get the hang of what information they need from you in your opening post - but as a minimum you will need to post redacted photos/scans of all correspondence you've received from the council (both sides, if appropriate) as they need to see all the small print.

    PePiPoo has an excellent success record in dealing with council tickets.
