    eeek.

    That is a decent amount, I thought it was just the £150 that was taken
    )
    I may have missed it, but I don't think the OP has stated how much deposit was taken.

    Comms69 was guessing it might be £500, so the penalty would be 1-3 times that (£500 - £1500), but if the deposit was greater the penalty would also be greater (or vice verse).

    Plus court fees reclaimed of course as well.

    Yes it was meant to be an example - no actual figures known

    Although in fairness it was a good example...a months rent or thereabouts x 3 IF the full award is given for failure to protect.

    so no its not an insignificant amount
    in S 38 T 2 F 50
    out S 36 T 9 F 24 FF 4

  • The amount of the deposit was £775 however £625 was returned following deductions.

    Would the 3 x penalty apply on the £150 that was deducted or the full deposit amount of £775?

    Thanks in advance as always.

    The full amount - so a penalty of £775-£2325

    Though the fact that some was returned might incline the judge to award less than the maximun amount eg 2 x 775 rather than 3 x 775. That's up to the judge's discretion.
