    Agree with everyone else.

    Legally maybe but morally wow!

If the shoe was on the other foot and your family gifted 10k and you put in 5k he put in 1k would you happily hand over 10k to him?

Probably not. Would you be here asking why your ex should get half a deposit you/your family put down and suggesting he was greedy.

    Possibly

You put £1k into the property. He put £4k in and his relatives gifted him (they didn't gift you half, they gifted him and whoever his partner happened to be at the time and now you're not) £10k.

So get an idea of what the house would sell for, not be advertised for, and deduct the current mortgage balance and that's your equity. If it's greater than £15k, you should get £1k for the first £15k and then half the rest. If it is £20k equity that's £3.5k for you.

Unless you have children or were married you shouldn't make this complicated. Houses don't pay out a fortune after just a couple of years of ownership unless the market is rocketing. Plus you wouldn't be getting any money if you'd been paying rent instead of a mortgage, as we all have to pay for a roof over our heads.

I agree with this, plus life is short get out fast, start afresh put the split behind you and restart life the 5 k is enough of a lifeline to start again and I wish you a tangled free separation, that’s actually priceless

I understand what you are saying but the solicitor seems to think that what we put in for the deposit won't matter as there wasn't a declaration of trust written up?

Whatever he ends up paying - it'll be a bargain in the long run now you've shown your true colours.

Indeed. I have a friend in the same situation where her OH who only has debts has beggared off, the house is being split and it looks like she will lose half the inheritance from her Dad which is a considerable sum. After 20+ years together she trusted him not to need a declaration of trust when they bought the house a couple of years back. Unfortunately that trust was misplaced.
