Paypal funds held? there's always one!

I've been an ebayer for years, sometimes selling and mostly buying. I tend now to build up a batch of stuff and list it all at once, then enjoy the rewards.

This time I sold over 40 items and made a nice bit of cash, BUT there is one buyer who contacted me to say that the goods weren't as described.

I listed my daughters dance shoes - in the CHILDRENS DANCESHOES category, and "stated they are actual size 5 "but also wrote on my listing that to "remember that dance shoes always fit smaller than street shoes." The email I received said "these are way too small for me and are more like a childs shoe" " and of course, " goods not as described, I want my money back"

I replied by email that I had accurately desrcibed the shoes AND listed them in the correct category, so I did not wish to refund anything. This buyer has now opened a "Goods not as described" claim with paypal.

My questions are
1. I had already requested a withdrawal of funds from paypal, BEFORE the person contacted me, Is my request likely to be denied, pending the outcome of the dispute? I do have some funds still in my account that would cover the refund IF/WHEN paypal award claim against me.

2. I actually think that the danceshoes don't fit the buyer and thats the only reason they want a refund, having looked at the paypal dispute process I would think it's unlikely that the claim would be awarded in my favour. Has anyone ever had a claim like this and won it?

I am really frustrated at this buyer, and with paypal, Does anyone have any good advice?

    Its always nearly awarded in their favour. The only thing you can do is leave poor feedback and email them a virus hoping they dont have protection....

    Thats what I do anyway.... Im a vindictive old !!!!!! though ha ha!
  • It should not go against you, if you've listed a pair of size 5 shoes and they are size 5 then you've described them as they are.

    So the buyer filed a claim with paypal claiming goods not as described. I responded stating all the facts and waited. Received an email from the buyer saying she was returning the shoes, I told her I did not accept her doing that and escalated the claim through paypal to allow them to decide. :angry:

    I hadn't realised how much Paypal is totally geared to protect the seller, as after I had escalated the claim, I received an email from paypal to tell me I had 10 days to respond otherwise the claim would go against me! I did respond to myself and again gave the facts and offered pictures to prove correct shoes size. I was very concerned that the system was so against the seller that I telephoned PAYPAL and spoke with a lady who made it very clear that they must never deal with this sort of situation as all she kept suggesting was that I could accept the shoes back, give a refund and re-sell the shoes, no matter how many times I told her I had been 100% accurate on my listing :wall: eventually she gave me an email address [EMAIL="Reversals@paypal.com"]Reversals@paypal.com[/EMAIL] and said I could try to contact them and tell them everything I had told her, and give them the dispute number and they would have input into the decision about the refund and have to the power to undo decisions, such as funds on hold etc. I have emailed them, offered them pictures and now just have to wait and see what they decide.

    I know to some reading this I may seem unreasonable, but I have given refunds in the past, when I had accidentally listed something with an incorrect description. This time though I know I am right and the buyer is only looking for a refund for something that is too small.

    Blimey I'm not marks & Spencers!! :rotfl:

    p.s the buyer emailed me to say she has posted the shoes back to me!! WHAT NOW??? :confused:

    Simple, do not sign for them, paypal will want proof of delivered return.

    But if the OP refuses delivery and they go back to the buyer, and paypal find in the buyers favor, then the OP has lost both the goods and the cash..

    Just answer in the paypal dispute " for them to be returned" The buyer then has to return them at there expense and they will need to be signed for by you, if they don't send them signed for back you then who's to say if they arrived or not!!,
    If they do arrive signed for then just refund back the money its just not worth the hassle, You can always file a non paying bidder alert to claim your fees back and relist them as im sure they will sell next time.

    I do have a bad feeling it will go in favor of the buyer just because thats what Paypal are like. :(

    It REALLY REALLY shouldn't though, bloody idiots should look at what they are buying !!!!!!.

  • If it goes against you it just goes to show how shoddy Paypal are, everyone knows shoes of the same size do not always fit, that's why you try them on at the shoe shop. If you describe a pair of size 5 shoes as being size 5 it is difficult to see how that can be "Item not as described".

    the buyer complained using the reason "not significantly as described"
    "significantly" is the operative word here.

    did you use the term, childrens shoes, size 5? if so you will/should be ok.
    Get some gorm.

    Next time just take cheques and postal orders.

    That way you get to decide who gets a refund.
