Parking at work

Recently it’s been suggested that cars parked within the staff car park will be blocked in with a barrier to prevent staff leaving early.

Can this be done?

    what sort of employer is this? is leaving early an issue? do staff have contracted hours of work ( ie 9-5pm mon-fri)?
    why are people leaving early?

    Doesnt sound like it, what happens if a member of staff has to leave in an emergency?
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"
  • This is at a private company.

    Hours aren’t fixed but a minimum number of hours is expected over a week.

    The problem is some staff leaving earlier than they should.

    This should be something thats dealt with by effective management, if the staff arent meeting the minimum hourly requirement then it should be a disciplinary matter.
    Stopping people getting out would have an impact on when people need to leave in an emergency

    My guess is the other option on offer would be to park outside of the provided staff parking.

    ...... or they could walk out ........... then get a better job with a more reasonable employer.

    Blocking a car in is illegal under the POFA 2012, but there is a limited exemption for a barrier car park - e.g. where the car park happens to be shut at night.

    What you describe sounds like illegal 'blocking in' and holding drivers of cars into the site - however the Police won't be interested. What might be good is if any union rep or 'spokesperson' quotes the original POFA section 56, about 'blocking in' to whoever is proposing it and points out it is illegal. I suspect they have no idea.

    Never mind POFA. it sounds to me as if it would be in breach of The Human Rights Act.
    You never know how far you can go until you go too far.

    What sort of barrier?

    I could see this system working IF it was swipe card based, programmed with your hours, so won't raise until your allocated earliest time of departure.

    If you needed to leave early, this would have to be agreed with management and a "override" card issued.

    However, it seems a lack of effective management if they feel they have to go to these lengths to solve the problem.

    Maybe some verbal warnings on timekeeping would be more appropriate!!!

    I cannot, read the aforementioned Act of Parliament.

    Check which bodies come under Human Rights. Private companies don't unless they perform a public function .
