Just a brief update: POPLA compliant team has just informed me that they are considering a procedural error in the first decision and are reviewing the case, this is an extract from the response I just received:
[FONT="]I have reviewed the assessor’s decision and I consider that a procedural error may have occurred, which may change the outcome of the initial decision reached. [/FONT][FONT="]As such, I will complete a full review of your case and respond to you within the next 10 working days. It is important to note that financial recompense will not be awarded if a procedural error is identified and my review may not change the outcome of the decision.[/FONT]
Obviously our complaint contained the right key-words, so many thanks again for all the great input that helped and encouraged us not to give up early.0 -
Good news so far, but there's still the opportunity for POPLA to make an even more spectacular hash of things! Keep us posted. Well done on your work to date on this.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

YES YES YES, POPLA has revised the first decision :dance:. I received the good news already today:
[FONT="]I have now completed this and found that you queried whether or not Parking Eye had the relevant authority to issues Parking Charge Notices on this land and that this was not address on the original appeal.[/FONT]
[FONT="]Upon review, I note that the operator failed to provide a copy of the contract with the land owner or a statement confirming that it has the relevant authority in this land. As such, the appeal should have been allowed. [/FONT][FONT="]The amended decision has now been uploaded to the portal.[/FONT]
[FONT="]My review and decision now concludes our complaints procedure and there will be no further review of your appeal. [/FONT]
[FONT="]In closing, I would like to apologise for our error and I would like to thank you for bringing your complaint to our attention. I am sorry for any inconvenience and frustration that we may have caused.[/FONT]
So it really has been worthwhile to go this extra mile in this case in which the first decision was clearly not correct. Also I believe it is a good and encouraging sign that the review was done so quickly. Again my credits go to all who contributed to this success, thank you for this great support. Without your help I would now be 100 pounds and some valuable experiences poorer.
For completeness let me share the first paragraph of my successful complaint, I had modified it slightly from what was posted earlier. Especially I actually refrained from addressing it to John Gallagher directly (in order to have another escalation instance if necessary):
[FONT="]Dear POPLA Complaint Officer,[/FONT]
[FONT="]I am writing to you in reference to the recent POPLA decision in my appeal XXX. I am aware that appealing at POPLA is meant to be a one-stage process. However, after carefully reading the assessor's rationale I came to the conclusion that there are obviously procedural errors and perhaps also technical problems related to this case. Therefore I am not only sending a formal complaint, but I am also asking to review the case. I will not hesitate to accept any decision that is explained and comprehensible, but I can see several conflicts with existing and applicable regulations, especially with the BPA Code of Practice Version 7 and the Protection of Freedoms Act 2012.[/FONT]
There have been no changes in the other parts.0 -
