I worked for npower who were fine with the debt as long as i coukd prove i had a payment plan in place.... i coukdnt do that because
A.its not my debt
B.using my dads proof would have been breach of data protection act
As such they coukdnt sign me off to work so had no option but to terminate my contract.
All employers so far have been the same story....im just too much of a risk apparently?
I got a letter from the plaintiff stating it wasnt my debt and i had never held an account with them but thats of no use
The problem i have is i cant prove legally to any employer that the debt isnt mine and as such its screwing up my work options.0 -
I just need this sorted out but obviously i feel i am due some sort of compensation as this has affected me financially and mentally my credit score is shot to hell i cant get any sort of credit and prior to this saga i had never had as much as a credit card.0

Your “score” plays no part in this.
Ask the CRA’s to remove it from your files by raising a dispute with each of them.
I’m assuming you’ve checked with all 3 CRA’s?0 -
If i raise a dispute is that not just as bad as having it there? I.e just because it is disputed it doesnt make it wrong? It just merely means i disagree?0

No, you would be disputing the accuracy of the data recorded on your three credit files. If i raise a dispute is that not just as bad as having it there? I.e just because it is disputed it doesnt make it wrong? It just merely means i disagree?I work within the voluntary sector, supporting vulnerable people to rebuild their lives.

Would this be best to do in the meantine while i have it recalled to court or is this an option instead of recalling it?0
-
It is a separate matter. Having your three CRA files data recorded accurately is your right. Having the CCJ amended is another kettle of fish entirely and you need to make a thread on legalbeagles about that.I work within the voluntary sector, supporting vulnerable people to rebuild their lives.

The CCJ isn't necessarily in your name the lawyer have filed the claim but omitted the DOB. The CCJ will have been put it on the public trust register. The fact that only one of the ther main CRA's links it to you probably means the other two have linked it to the correct person, your father. As the debt was your fathers and the CCJ was put on for that debt, I'm not sure the whole set aside route needs doing more clarification with the courts from the lawyers as to whose it is.
Strange how all the companies you failed credit checks used Equifax. Companies don't use all the CRA when doing a check and usually just one.0 -
I find it strange that a credit union would have used a firm of solicitors to obtain a ccj against an individual who was already in a payment arrangement with them and was apparently keeping up with the payments.
The OP's employment problems do seem a bit confused as he allegedly lost his self employment then obtained a job where he deals with customers bank details/card details. I would have thought that any necessary checks would have been carried out beforehe started in the job not subsequently.0 -
To clarify having signed up with credit larma the default doesnt show with transunion either so does this mean that if i dispute it with equifax then the problem is solved?
As stated my father knew nothing of the judgement till i informed him.
I didnt lose my self employment i decided to stop working for myself as my income became too sporadic as i basically worked on a commision only basis.
On starting my employment with n power i had to declare unspent convictions and any adverse debt i had.....this is when the judgement was found.
Would it be a safe assumption that by disputing this with equifax it will be removed from my file/report and having the lawyers clarify with the court who the debt belongs to then all will be sorted?
Most companies use equifax...especially in the financial sector as apparently they do a more in depth search.....ive also noticed they have me as having financial associations with 3 people....my mother and 2 people I've never heard of? If those people had adverse credit would that affect me too?0
