Double Glazing problem urgent advice sought

I have a problem with a supplier which requires urgent advice - although I have signed a contract, I was never told by the rep I had the right to cancel. So I was enraged to find in the Schedule of Work that the rep has indicated I was informed of that right; and among other statements - eg Treating Customers Fairly and Code of Practice information – which were never mentioned.

For various reasons, unfortunately, I ran out of time to cancel. The deposit has been paid and the supplier was adamant. I've been told if I cancel the penalty is 25% of the total cost, which will leave me with a derisive £50.

I am now being bullied into signing a further document to regularise the matter since I indicated I would go ahead. However, nothing has been done to date to process the matter so can I seek advice whether Consumer rights could help and a link where I can find them.

You either have the choice to go ahead with the work or not.

If you don't want to then cancel and seek advice on reclaiming your deposit.

If you do want to go ahead then presumably signing their is the step paperwork.

    Consumer rights act is here:

From my reading your post doesn't make it clear specifically what you wish to do?

  • Thanks for your response but I am paying a premium price for the work compared with other suppliers' products.

I want to cancel without the penalty of losing most of the deposit, on the basis that I wasn't able to exercise my cancellation right and falsification by the rep of my supposed responses; return of my full deposit if I have a case.

I was really looking for advice if the forum thought I had a case to raise with the Consumer Advice Bureau and a link for them.
  • Your best bet is to either message the poster Unholyangel or wait until they post here as they are probably the best to advise you on what information must be given to you and how.

If it then transpires you can demonstrate that the information wasn't provided to you as required and you may cancel without a deduction you would most likely need to cancel and then issue small claims proceedings to recover anything they refuse to refund that should be due.

Further to the above, how did you pay the deposit?

Buyer's remorse, because you didn't do some comparative shopping or research beforehand?

That said, if the company hasn't been correct in their contract, you should be able to cancel without penalty.

Unfortunately they hold all the aces. You signed the contract indicating you had the right to cancel whether you deny this or not.

To the lay man this will look like buyers remorse as you have now told us you found a better deal elsewhere.

How do you prove your case? You will struggle to fight them on this.

What double glazing have you ordered that is costing you in total £200 (if £50 is 25%)?

It's not even that. If the penalty is 25%, OP is left with 75% (£50). That makes the total cost £67.

I think OP means the cancellation fee is 25% of the total, for example you pay a £1000 deposit but the total job is £4000 meaning your cancellation fee is the deposit (give or take for the £50 the OP mentions)
