Yes... I agree... but the students who were copied into the email has specifically asked if I could help as they were being ignored.... and by writing on their behalf with them copied in it saved me writing a document in English for them to then forward on to the agent and then asking me to explain the outcome... etc...
Comms69 Sorry that it didn't make sense... however those were the words used to me... and I agree that the students could be liable for charges (in particular a standing charge) after they vacated and I did mention that... however, if anyone is using electricity after they left (most likely landlord carrying out upgrades, then there is a grey area)... however, as we have both agreed, the landlord has no right to see the bills of the tenant and these are nothing to do with the deposit return...

If nothing further comes of this, then I will advise the students to send a ltter before action, which I can help them draft but will get the actual lead tenant to send.0 -
The correct - the only legally possible - response at this point from the deposit holder would have been "Sorry, but we cannot discuss this with you."
You can advise your students. You cannot do it for them, not without holding power of attorney on their behalf.
Not necessarily for the purposes of discussing the matter, the students can consent to have a 3rd party discuss it.
But in order to take legal action that is correct.0 -
have you/they checked yet whether the deposit wa protected elsewhere?
Just send the LBA. Whether you include the penalty depends on the answer to the above.0
