    Hmmm...I would email a scan of both letters to Steve Clark at the BPA and complain about their member offering POPLA one week, then sending what appears to be a pre-court financial harassment set of paperwork, the next. Ask how on earth a person is expected to know what is going on, given there is a month to appeal to POPLA and PPCs are required to 'stop work' on a case while in the appeal system.

  • Immediate response from Steve Clark referring me to BPA portal. I have filed a complaint with them.
  • BPA have acknowledged my complaint & contacted Civil Enforcement for a response, I am told this can take 14 days.
    I feel they have broken section 22.6 of the BPA practice code by not stopping work on the charge.

    The BPA usually reply saying it's all been a big misunderstanding and as a gesture of good will the ticket is cancelled.

    As the ticket no longer exists then no breach of the Code of Practice has occurred.

    If and when the BPA get the ticket cancelled (which is what they normally do) it will no longer exist. No sanction points can be awarded for issuing a ticket that doesn't exist.

    Because, if the ticket (PCN) were to be cancelled, there has been no breech of code. waamo is not saying the ticket (PCN) IS cancelled but is predicting what is LIKELY to happen.
  • Success. My parking charge has been cancelled. Following the excellent advice on this site I contacted the landowner, I parked in Debenhams Guildford.
    I suggested they look at the practices of the company managing their car park as I felt these weren’t in line with those of Debenhams. I pointed out all the negative publicity online.
    Whilst waiting for a reply from a separate complaint to BPA, the sales manager at Debenhams Guildford replied saying they had contacted the car park operator and that they had agreed to cancel the PCN.
    A letter from Civil Enforcement arrived the same day confirming the cancellation.
    Can I thank all those that took the time to reply to my post & the excellent advice provided.

    Well done, one nasty monkey off your back.

    If I was asked, I would guess it might be more the pressure exerted by the BPA sniffing around than Debenhams requiring a cancellation. I might be wrong (2nd time this year!:rotfl:), whatever, the job’s done. Nice one. :T
