Parking fine sent to old address

Hi all,

Not sure if you can help or not. We moved house a few months ago but I went back today to collect some post and found we have a NtK from Initial Parking at Fistral Beach from 4th September and a further letter from the Debt Recovery Plus as we didn't pay the initial fine. Turns out even though I changed my driving license and tax information on the car I totally didn't realise I had to change the details on my vehicles log book as well so all post relating to this went to our old address (my fault completely). I just spoke to a very rude man at the Debt Recovery Plus who said as we have past the 28 days we had to appeal we have no choice but to pay the fine and cannot appeal if further. Does anyone know if this is the case? If we just have to suck it up and pay then we will, but I would have liked the chance to appeal as for a start the images they have sent us of our vehicle have no time or date on so they have not provided me with any proof we actually went over our allotted time.

    What is the tax information, if it is not the address details on the V5C? One thing we all agree on is that Debt Recovery Plus seem to only employ "very rude" operatives. Since you have gone beyond the appeal stage, you have to sit back and wait for letter before action and then formal court papers. In the meantime: -
    1. Send a Data Rectification Notice to the DPO of the PPC advising them of your address for service and requiring them to ERASE your old data.
    2. Submit a SAR to the PPC asking for all data about you etc.
    3. Go to the NEWBIE sticky post # 2 to find out about writing a defence, submitting a SAR and the whole small claims court procedure.

    t is not a fine, it is an invoice from and ex scammer for damages for the harm they allege they suffered when you did what you did, You do not owe a penny unless a judge says so.

    [FONT=Times New Roman, serif]Nine times out of ten of these tickets are scams so consider complaining to your MP, it can cause the scammer extra work.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
