Unfortunately POPLA is now a game of "assessor roulette".
Even if an "appeal" refers to cases such as Excel v Clever Car Finance and includes a statement (in bold letters) that "for the avoidance of doubt the driver was not a company employee and was not engaged on company business at the time of the alleged parking incident" some assessors will still copy and paste their "Sector Expert's" words stating that the driver is presumed to be acting as the company's agent.0 -
I have now got a picture of the sign at the entrance to the car park, and it is indeed obscured. How would you suggest I work this into any rejection?
I also emailed sainsburys CEO and got this response:Thank you for your recent correspondence that has been passed on to our Executive Office. I have been asked to look into your complaint and personally respond.
I was concerned to learn of your disappointment following the parking fine that was issued to you following your recent visit to our Wandsworth store. I understand the frustration this has likely caused.
Please be advised that Sainsbury's have no jurisdiction over the issuing of these fines and as such we would recommend this is appealed through the car park agents, Horizon, directly.
Whilst I appreciate this may not be the anticipated response, I do hope this further assists.

Sainsburys contract with Horizon and they are the principal in the arrangements.
Tell them you know this and you know that their reply is not true and that they can certainly get these scam PCNs cancelled when it is their own contractor, Horizon. Different if Horizon were not working for Sainsburys, but they are.
Add that Sainsburys should be ashamed of allowing customers to be harassed and sued by such a notorious member of a scam industry.
Add in any proof of spending the family (extended family?) has made this year and pile on the pressure that you will all vote with your feet/wheels and stop shopping with them if they fail to support you.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I did that already, I spend loads in there. I showed how much I spent on every visit when fined but also attached the last 3 months of Sainsburys transactions (over £1k).
I will follow up with an email and a call0 -
Concentrate on telling them you KNOW Horizon are their contractor and if they lie that they have no control over them, ask to speak to a Manager, then their manager, etc. Stay on the phone. Stay on that phone till it is CANCELLED.
Of course Sainsburys can tell their agent to cancel a PCN, like (you can say truthfully) Morrisons do with ParkingEye every day of the week, because M's have realised what a mistake their parking contract was and support customers v the parking firm, routinely.
Ask why Sainsburys are failing to realise the scam operated and the effect on custom.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
