Breach Code 3 - Parked in an unauthorised area

Hello all,

Yesterday to my frustration I received a £100 parking fine, £60 if paid within 14 days.
The Breach Code was 3 - Parked in an unauthorised area, I was not blocking anyone in and I had already paid for my parking prior to parking, however on my arrival there was no bays and there was some cars parked against a curb not blocking any cars in. Further to my case the only bays nearby the two cars beside mine had even managed to make it out of there bays.

I'm yet to appeal this because I wanted to get everyone's expert advice on the best way to fight this in order to not pay the hefty fine.

The fine was issued on behalf of Govia Thameslink Railway and formally issued by Saba Park Solutions UK Limited.

There are hundreds of threads about Saba (formerly known as Indigo) at railway stations, so all the advice has already been given. Do a number of forum searches on keywords Saba Govia, Saba Railway, Indigo Govia, Indigo Railway and read those threads and follow the advice given - it's all too detailed to type it all out all over again on every single Saba case that crops up.

Read those with the most up to date detail. When you are clear on the course of action you are proposing to take, you can tell us what it is and we'll guide you on it.

HOW TO USE THE FORUM SEARCH FUNCTION:

Hit your 'Back' button to get back to the forum thread list. On the bar just above the threads you'll see the 'Search' function. Click on the 'Advanced Search' button and on the following page place your keyword(s) in the 'Search By Keyword(s)' and make sure the 'Show Results As' button (at the foot of the window) is changed from 'Threads' to 'Posts'.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • As Umkomaas says, please follow closely all the advice on here before you appeal - well done for checking in first! I don't know of any appeal that has been 'allowed' by Saba, no matter how reasonable. I mean, yours is totally reasonable and they didn't lose any money on account of your parking did they! No doubt they will find a reason to pursue you for the money anyway. Just keep records of your appeal and their replies, and make sure you get past the 6 months. You'll be fine!

    Good luck!

When you paid, was a space guaranteed? If so, then read about frustration of contract.

Nine times out of ten of these tickets are scams so consider complaining to your MP, it can cause the scammer extra work.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies
