Inheritance payment after IVA

Hi,
I am hoping someone can help please.
I have one final payment due on my IVA after 5 and a half years (6 month extension from a break was taken). The past few years has been a nightmare but light is at the end of the tunnel!
My uncle passed away with an unsigned will in which I was named and I updated my iva company as I was unsure I would receive any inheritance where being so close to end of my iva I wanted to be open and honest.
Now I’m at the end will this effect me receiving a completion certificate from me being too honest in a circumstance I may get nothing and if I do get any inheritance will my IVA take this? Thank you

    If the Will is unsigned then he has died intestate so no need to inform your IP yet, unless you receive something from the Executors before you finish your IVA.

    Shame you have already informed them as now they will have their beedy eyes wide open.
  • What is happening with the unsigned will? Anything? I would speak to whoever is dealing with it to find out what will happen with that now and an estimated timescale.

    Do you have any property that needs an equity review? Any outstanding income reviews? etc or is it literally the final payment and then a completion certificate can be issued?

    I would get the info on exactly what is happening with the estate and then speak to your IVA company and ask that they ask the IP how this affects your IVA and if you need to do anything.

    It’s his daughter who lives in another country who was named on last signed will. I know there was a discussion that the unsigned will was going to go into probate earlier this year but no further news.
    I have all reviews up to date, provide monthly wage slips and no property, no outstanding payments so it should just be straight forward closure but worried they will drag my completion certificate. Can they do that just to see if there is anything they can get? Thank you

    If the Will is unsigned then the Executors will action the signed Will, if they are playing by the rules.
  • It really depends on the IP. However taking 6 months for a completion cert and final report isn't usual for some IVA companies. Your best bet is to speak directly to them and ask for timelines for the timelines for when the IVA final report will be sent.
