Santander claiming not Data Controller

We’ve had a letter from Santander stating they are not the data controller for Byte Computers and to redirect out ppi claim to them.

Has anyone come across this before? The ppi was on Lombard Tricity Finance statements, which according to frc is Santander.

Of course the letter has no return email address just a generic P.O. Box address and 0800 number.

Any advice

    Who sold you the PPI? The provider is rarely the seller.
  • It’s on the Byte Computer Superstore statements which has Lombard Tricity Finance on the statements.

    That is correct. The term "data controller" also suggests this is a data subject access request you have made.

    However, Santander didnt sell the PPI.

    You complain to the seller. Not the lender. Only in a small number of circumstances does the lender or insurer take on the liability on the behalf of third parties (mainly store cards). With loans, it is the seller. Which would appear to be Byte in this case.
  • The statement is no different to a store card statement with a credit amount that could be borrowed upto, i will see what other paperwork I can find.

    Byte Computers was acquired by PC World in 1998 and ceased to exist as a separate brand. Accordingly any sale of PPI would be pre regulation (which started in 2005) - no mis-selling complaint is possible.

    I would be interesting to know why they have used the term "data controller". That is not a term you see with a PPI complaint. Its a term used when asking for details under the data protection act/GDPR.

    Whenever I’ve seen ‘to the data controller’ it’s been from people thinking they know what they’re on about, threatening all sorts of referrals to the ICO and the FSA if we didn’t send them a refund within 7 days of them sending a complaint by 2nd class post for a policy on a mortgage from 1970 on an address they can’t remember.
