Responsibility for fence

As the fence needs to be completely on your property, then if you erect fence posts on your land and then attach boards to one side of those posts, if you attach them to the far side of the posts then all the land between the posts remains on your side of the fence, whereas if you do it the other way round you neighbour gains the use of the small amount of land between the posts.
Fence panels generally go between the posts, not on one side or the other of them. Assuming the posts are at the extreme edge of the property, the same amount of garden will be 'given' the neighbour irrespective of which way round the panels are fitted.0 -
I feel your pain. It's quite stressful this owning a home and neighbours lark! Not sure it will help, but we have one side of our rear garden with an okay fence (to the right), and then the other side (to the left) a stone wall which has been repaired probably about a 100 times. It's in dire need of replacing, but to remove all the brickwork and then get it replaced I reckon would be in the region of £1500-2000. Long boring story short, we got a copy of the deeds and the right side was marked with a T icon as responsibility for the neighbour on the right. The left side didn't have a T icon or any other symbol. According to our solicitors the wall is therefore 'presumed shared'. Not sure if it would say anything on your deeds, but sometimes it's worth checking anyway - even if it's just to say you've checked it. These things are a 'ball ache' to put it nicely, but I wish you luck!0

Thanks everyone, it’s a normal feather edge fence and hopefully he might offer to pay towards it but if not I can see we will have to foot the bill.0
