    Hi all, so I received another letter in the post which contained some deadlines this time. 
    The deadline is sooner than expected but I’m not too worried as I’ve done everything but my costs schedule, which leads me to my question...

    at what point do I submit my costs schedule? 

    With my witness statement&evidence to the court?

    after the hearing? (If I win)

    to the claimant?

    Also, the amount I’ll be claiming in my costs schedule totals out at well over a grand. But this is an accurate total which includes the countless hours I spent preparing things, responding to letters, posting & mileage etc. (@ £18 p/h)

    also, I’ve updated my statement of truth as per new newbies thread advice.

    Fortunately I already included the two photos of struck out abuse of process claims so haven’t needed to change my defence or WS.

    You file (to the court) and serve (on the claimant) your Summary Costs Assessment (as it is called now) with your Witness Statement and evidence.  Obviously, if you submit with the WS, it is before the hearing.  Don't miss your deadlines and don't forget to ask for your costs when you win!  This is all assuming it will be a face to face hearing and not a telephone one, where different arrangements are in play - see telephone hearing thread: -

    Hi guys, I’ve just sent off my evidence to the claimant. And dropped it off to the court, a few hours before the deadline. 

    Quick question though, I have yet to receive anything from the claimant. And likely won’t before the deadline. Could this be used against them? Is it worth mentioning to the judge that they were XXX days late in serving their evidence?

    Did you get your Costs Assessment in, at £19 per hour? It hasnt been £18ph for a long time now.

    You ask the court if they have acopy of the Cs bundle. Mentuion YOU dont. Ask that this is placed on file for the attention of the judge, and that you ask the court to SANCTION the claimant for their breach of the court Order of XYZ date...

    Hi,

    yes I’ve done my costs schedule stuff. Totals at well over a grand!

    do I call the court to ask about the claimants evidence pack/sanctioning ASAP? Or wait a bit longer (a week maybe), As the deadline is in 2 hours and technically hasn’t passed yet.

    Summary costs assessment. NOT schedule. You were told the right term to use! Did you separate out the two o bvious sections of ordinary costs (costs of the hearing ie time off work or loss of leave) and the unreasonable behaviour costs? You never showed us. 
    Wait until tomorrow, obviously.

    Why do people always want to PHONE the court...leave them be.  They are busy.

    This is not something to chat to a court clerk about, also why raise it yet?  Softly softly catchee monkee.

    You just mention it at the hearing to the Judge as your first preliminary matter, and invite the Judge to dismiss the claim and grant your costs in full, due to the Dammerman high bar (unreasonable conduct) having been met.

    Hi,

    yeah ive named it summary costs assessment as the newbies thread has been updated recently.

    the sections however, are not separated. Instead I made a long list (including time off work, travel expenses etc.) and listed the hours each list item took, e.g.

    researching how to write a legal defence/WS - 30 hours

    Time spent responding to various companies representing UKPC: xxx
    postage costs for above: xxx
    travel to and from court 30 miles @ £0.5 Per mile - 1 hour

    ————
    total hours (billed are £19 p/h): 87

    Total mileage costs (30x0.5): £15
    total cost claimed: £1668.00

    Ive also done a seperate summary of costs for my witness.

    Note the above example is very rough and my actual summary is a lot more clear and detailed

    Fine, but you realise some are usual costs, and some require the court to agree? If youve mixed the two up, MAKE SURE YOU KNOW which costs are which!
    C-M - why not call the court? finding out the corut doesnt have a copy is useful. Otherwise youre essentially stating
    - i knew i was supposed to have the bundle by X date
    - i didnt get it by X date
    - i didnt take any steps to find out from anyone, if they had a copy already, or if mine had been lsot
    - but by the way, can the C just plain *lose* as a result?
