PCN - Advice on Letter of Appeal is correct?

Hi, I've read the newbie details and I hope I have understood them correctly.

I've received a PCN via the post for parking in a Britannia Car Park in Milton Keynes, which are operate a camera service. They have provided images of my vehicle arriving at 2.02 and leaving at 2.30pm. I am not the driver at the time of the incident. The driver genuinely tried to pay via the app, but after struggling with poor internet service (for a long time!) couldn't get the app to work so left.

I've composed this letter from the template on MSE and I've removed the bits I felt were not relevant to my case (maybe they are?!?).

What would your advice be on the below:

Dear Sirs/Madam,

Re PCN number:

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a formal complaint about your predatory conduct to your client landowner and to my MP.

There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.:

- The driver was not parked during the times on the Notice. All the notice gives is the time in and the time out. By giving the photos you have proved that the vehicle was not parked. The vehicle did not overstay as it had to find a place to stop, get out to read the signs, try to register to pay (with no internet connection) the vehicle then exited the car park.

- in all cases, you must include a close up actual photograph of the vehicle parked.

Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service in the future.

Yours faithfully,

Any advice would be great - thanks in advance.

One of the reasons for using the template unedited is that the scammers recognise it and then know you are getting help from this forum. By changing it you run the risk that the scammers may not recognise it. A few scumpanies give up when they see it but I don't think Britannia is one of them.

What you have looks OK except you need to mention The Driver. The car didn't park itself and go and look at signs, although that technology may be available one day.

The vehicle did not overstay as [STRIKE]it[/STRIKE] the driver had to find a place to stop ...

What happened when the keeper complained to the landowner?

Don't forget to follow through with your threat and complain to your MP about this unregulated scam.

  • Thanks Fruitcake for the advice, it's much appreciated! :)

Is there anything I have removed from the template letter you feel I should add back in?

I haven't complained to the landowner yet, this is my next task to do when I find out their details. I will make sure I contact my MP too.

This is day 12 of receiving the initial PCN letter.

    Many thanks!
  • I'm after some more advice please :)

I have received an email from Britannia Parking who have denied my appeal.

Can you advice what my next steps should be, do I now proceed with POPLA?

    Many thanks!

You need to read the rest of the Newbies thread, the one you got the template from. It has detailed instructions for POPLA
  • Waamo, thank you for the advice.

I'll have a read through the thread for POPLA.

    Many thanks!
