Small Claims Court

Has anyone any experience / advice about making a claim against a third party insurance company for losses resulting from an RTA? Liabilty for RTA is not denied but losses are.

    Your claim wouldn't be against the insurance company, it would be against the driver of the vehicle. (I assume somebody crashed into you.)

    The driver would pass details of your claim to their insurer, and their insurer might then use their legal team to defend the claim against their client.

    What is the nature of the loss that they are disputing?

    My advice (for others) is get standalone legal insurance (from £12).

    Do you have any reputable providers or brokers to provide this?

    It was originally a 'hit n run'. They have paid for vehicle which was Private Hire. Refusing to pay Loss of LA Licence Fee', vehicle was totalled, & Loss of Earnings, for period between accident and when I replaced vehicle at my cost because they had not yet accepted liability

    So like I say above, your claim is against the driver of the vehicle.

    The legal basis of your claim is for negligence. (The driver hit your car because they were driving negligently). And you have suffered losses as a result of their negligence.


    In theory, the driver could defend your claim themself, but it's more likely they will ask their insurer to defend it.
  • It's my understanding that Legal CVover protects you in the case of a claim being made against you.
