Scam by euro parking

Hi Guys.

I desperately need your help and advice it will be much appreciated as I honestly dont know what to do and feeling very amxious about it.

29th of August I received letter from euro parking services letter that says:

Parking charge details:
pcn serial number: 7xxxx
Parking charge amount: £100
Amount paid to date: 0
Balance due: £100
Name and address of site:Mcdonalds Cape Hill
Reason for issue: parked for longer than maximum period
Date of issue: 31/07/19
Time of issue: 9:26

Then there are two pictures of me entering and leaving car park with no times nor anything on it.

Letter says keeper is liable now to pay 100 pounds and also notice to keeper been previously served containing full charge details.
It says its final reminder to pay within next 28 days and no appeals will be accepted as it's past 21 days.

So...i nevet received notice to keeper to begin with. first of all it doesnt say how long i overstayed. But funny fact is that day i was in Bristol and not birmingham. Second i never overstayed in that mcdonalds,i always go through drive thru. Anyway i sent them letter saying it was not possiblr and attached bank statement showing that day i was in Bristol as i made payments there.

They did not respond to my appeal and so i received another letter which says letter before court action. Letter says:

We are the claimant and are now about to commence legal action against you in order to recover the amount due as you failed to settle debt. We wrote to you short time ago but the following amounts are outstanding:
Date of charge: 25/07/2019 (???? Previous letter said date of issue was 31st of July).
Charge amount: £160

The debt relates to parking charge detailed above for which you are liable. We have previously provided you with full details as per parking charge notice and notice to keeper.

We intend to rely those documents in the event of court action being taken against you.
We refer you to the practice direction of pre action conduct under civil procedure rules and in particular parageaph 13-16 of the same, which deals with the courts powers to impose sanctions for any failure to comply.
We now require you to pay within 14 days. Alternatively please provide acknowledgment of this letter and a full written response within 14 days.
Your response should provide your full account of the circumstances that led to the charge being imposed and if it qas not you driving include confirmation as to who the driver of the vehicle were at the time of each incident and a current address for service of each driver that you name.
Unless you provide us with satisfactory response we will instruct our solicitors (gladstone solicitors) to commence proceedings against you without further notice in order to recover the amounts due and associated costs.

I phoned mcdonalds they cant help.
I know for fact i did not overstay as both days i werent around and i never even parked in tht mcdonalds. I feel scammed. None of letters says how long i overstayed even
Shall i keep sending them letters?

The pictures are of the vehicle , not of you , they monitor vehicle movements , not people

Come back to this thread if you receive a formal LoC or a court claim pack from the CCBC in Northampton within 6 years

That new letter is not an LoC because it gives 14 days , instead of 30 days

Shall i not respond now? Also i believe its actual scam as I never overstayed there but how do i prove it?

You might not be able to prove it , but it's them that have to prove their case , not you

I had two letters. One 29th of August and one just now. Both saying different dates of overstaying.

Probably worth doing a Subject Access Request (SAR) to get everything they have on you out in the open.

Email a SAR to the DPO at EPS to obtain all the documents and pictures and data about you and your vehicle attaching a copy of the V5C as proof of ID under the GDPR law

As you are new here , you should be studying the newbies faq sticky thread near the top of the forum , it has acronyms and SAR information etc, all newbies should study it

I could not see any advice on what to do when u never received details of parking charge, date keeps changing, u dont even know the times of ur alleged offence and lastly u never even did it.
Shall i be replying to euro parking services? I understood its not ignoring anymore

The time for appealing has long since passed. See what they send back when you submit a SAR
