Okay so my ESA was stopped and I had no choice but to put in a claim for UC, I’ve asked for a reconsideration to my esa decision but have been told that because I’ve put in a claim for uc I won’t be able to get my esa back even if the decision to stop it is overturned, I’m confused does this mean that asking for the reconsideration was completely pointless and what will happen if the decision is overturned?

If your ESA decision is overturned at tribunal, then you will receive a backpayment for the period between your ESA stopping and your UC application.

If your ESA decision is overturned at tribunal, your UC conditionally group will reflect the ESA decision. So if placed in the WRAG group at tribunal, you will be put in the LCW UC group.
If placed in the Support group at tribunal, you will be put in the LCWRA UC group, and receive the LCWRA £336pm UC addition.

If you have received ESA continuously since April 2017, you may receive an additional ongoing UC amount if the tribunal places you in the WRAG.
