Section 75 - Thomas Cook

Hi - Can anybody help please?

Like many, I've booked 2 x return Thomas Cook flights to Cape Town on my M&S credit card in my name. It was direct with Thomas Cook and with no ATOL certificate.
I've looked at other threads and seems it can take 30-60 days to get considered for Section 75 (I sent the letter off on Friday).
I really need to rebook before this before flights go up any more or are fully booked, but what I'm concerned about is newspapers saying you 'can TRY and get the money back via your credit card'.
Is it an open and shut case or is there a question of doubt?
I don't mind paying now to rebook flights as I can get the money from savings for something else but I could not afford to lose the money and pay for new flights.

    I'm still unclear though as to whether it's an open and shut case that a credit card supplier will pay out the full amount or whether there is some doubt? It's the words like ' you can try and claim', so I'm just not sure how likely it is or whether they can decline?
  • If you paid Thomas Cook directly, and not a third party travel agent, via credit card you WILL get all your money back under section 75, plus any consequential losses. Is that more clear?

    You don't need to use S75 to claim the cost of the flights back. You use a chargeback which should see a refund in a couple of days. But the retailer has 45 days to contest.

    As to consequential losses, then you need to submit a S75 claim. Just don't go OTT, or they can reject.

    I thought chargeback was just for debit cards? OP has stated they paid via credit card hence the section 75
  • Chargeback applies to both credit cards and debit cards.

    Chargeback rights are the same on Debit & Credit cards. S75 is a added bonus on Credit Cards that covers things that Chargebacks do not.
