someone drove into my wall before selling house!

I'm going to be repossessed soon because I lost my job & savings due to health issues (long story). I'm trying to sell the house before getting repossessed. While I'm busy preparing the house to sell, my friend drove me & my partner out for a coffee all together & she drove into my front driveway wall knocking it completely over. I saw it about to happen and shouted "STOP!!! STOP!!! STOP!!!" but it was too late & she drove into it.

She's on minimum wage and didn't offer to pay for it. I'm soon going bankrupt at this rate if I don't sell soon and can't afford to pay for it.

I couldn't afford to rebuild the entire wall, so I had to go into my overdraft and paid £180 to have half of it re-built and just throw the rest in the tip. This brings me even closer to repossession. It may not sound like much, but it is a huge amount to me right now.

After I explained my financial situation & how this could impact me, my friend just said "sorry".

A few weeks later I bucked up the courage to ask her if she'd be able to pay for it, and she said she'd be happy to pay for half, but only in a few months time.

My partner said: "It's just an accident", and "I wouldn't ask my friend to pay for an accident.", and "do you want to lose your friend?".

To top it off, I've told her not to park on my driveway anymore but she still parks there because she's staying with me and can't always find another space.

It takes a month to wait for bricklayers in my area because they're all fully booked up & it just so happens I got one on 48 hours notice because he had an unexpected day off- if it were to happen again, I basically wouldn't be able to sell in time.

I'm drowning in the amount of stuff do to to prepare the house to sell. My partner says "don't worry, if it happens again, she'll pay that time." - but I do worry because I don't need another job to do & can't spend more time having the wall fixed regardless of who is paying for it! I've been working 24/7 for ages on fixing up the house and have more than enough house jobs to get done already so I don't think it's unreasonable that I don't want the wall broken again.

I feel angry with my friend and my partner at this point. Am I wrong in the way I'm thinking?

    I don't know what your problem is? You just claim off her insurance, it's that simple.

    What makes you think it's going to happen again - surely even your so-called friend isn't that stupid?

    Well it wasn't deliberate the first time. She's just a bad driver, but thinks she'd good- worst combination. She doesn't notice what she's doing half the time. I suspect the only reason she never had an accident before was because other people swerve to miss her!! In this case, the brick wall didn't have wheels.
  • Just claim on her insurance - that's what it is there for. Hopefully her increased premiums will help focus her mind on her driving.
  • Report it to her insurance.

    Get the person to move out.

    Dump your partner.

    You should be contacting you lender to see if they will do an assisted sale. That way they are involved in the selling process and the whole thing should proceed smoothly.

    Is you house on the market? Any interest in it?

    Losing your home really shouldn't be on the list of sensible options to deal with debt. If you've been burying your head, this post is the perfect opportunity to put you towards a really supportive community and being debt free.

    You do need to claim off your friend's insurance. I'd suggest that frienship is dead if she has that little respect for you.

    If your friend has car insurance, that's what it is for.

    If she hasn't, shop the silly ***** to the police.


    You need to be firm with her. She offered 'to pay half in a few months' because she's short of money? Well, so are you! She caused the damage, she should pay. All of the cost, and straight away.


    I imagine selling her car would produce enough money to pay for the wall.......
