Uninsured Accident - Please Help

    And those wondering why im so concerned, this friend has done a lot for me and is really close to me but at the moment his really depressed and in pieces due to all this stress, his only 20 and regrets it but just wants to resolve it.
    His family depend on his income.

    Why would they "try it on"?
    As people have already explained, if the MIB do have to pay out they will then try to recover the money from your friend. They are not a charity in aid of the criminally irresponsible.
  • That is the wording required by the MIB to name them in proceedings.

    There is no trying it on.

    He either agrees an instalment plan via the court or waits for the MIB to settle it and agrees an instalment plan with them when they contact him.
    Mortgage started 2020, aiming to clear 31/12/2029.

    So what if he cant pay because of no money then..

    So what if he cant pay because of no money then..
    Same as any other debt.
    If he could but won't pay, he'll be pursued through legal routes.
    If he absolutely cannot pay, then he'll need to consider which of the various insolvency routes are best suited - and they leave no room to hide assets.

    What's wrong with that?
    If where possible, they didn't recover money, all that would happen is that even more of a surcharge would be added to the premiums of law abiding motorists and more people might risk driving whilst uninsured knowing that if involved in an accident, the MIB would pay out to the party they hit and apart from a fine, there would be no further financial comeback on them.
  • Thanks guys for shedding some light in this matter
    So by sounds of it and from the sounds of the letters he got, looks to me they are chasing MID for the payment (which in future they most likely will try to recover for him in which case would lead him going bankcrupt as he is broke and has no assets),

    Only question now theres a form which came from hm courts tribunals sevice and it gives option to agree to the amount claimed or defend it altogether, what to do
  • Am I the only one here who thinks that the OP seems to know an awful lot about:
    the accident caused by "their friend",
    the financial situation of "their friend",
    & all of the correspondence received by "their friend".

    Now, if I was a bit of a sceptic, I might just think that "the friend" is an imaginary one.
  • Like i said previously his a good friend of mine and not in a good position right now so im doing him a favour and trying to get advice for him. His going to get legal advice today so hopefully light end of the tunnel
