Tenancy deposit problem

Hello everyone,

I hope you can help me with my problem:I moved out of a property that I rented for 2 years and I am having problems getting the deposit of the real estate agency. The full story:
I moved out a month ago and I couldn't attend the end of tenancy inspection as I was in work at the time.A few days latter I received an email of the agent saying that there are a few issues with the house - amongst them was that the house was missing a few items of furniture that the landlord took to another property upon request as we had them already (a bed and a couch specifically) and that the house has a damp issue in a room that we reported repeatedly and they send someone out to resolve but failed to fix properly.
My question is can the real estate agent keep on delaying paying the deposit out?I should mention that the house was clean-i even repainted the walls, and the bills were paid always on time for over 2 years. And regarding the furniture they havent mentioned not even once in the inspections they have done in over 2 years for me to bring it up to the landlord (passed away recently so cannot confirm or deny my account of the story).
Any help will be greatly appreciated as it is really distressing me to see how slow they move with this and also their lack of communication.

You refer to a "real estate agent" so are you in the UK?
If so is your deposit protected? If so then reclaim it either in full or agreeing to whatever deductions you think fair.

OPs other 2 posts relate to Lloyds and Carphone Warehouse- so probably UK.

OP's use of English suggests he/she is not of UK origin; look at the word placement and lack of articles. My first guess would be Eastern European but could be from anywhere.
  • Thank you all for the advice, really appreciate it.
Also Smodlet you are right I am eastern European, I don't see how this has any implication on me asking for advice- apologies for my grammar and for not specifing that I am seeking advice for a deposit paid in England.

Hi michael00. You are right, your origins are none of our business; the only reason they are mentioned is to ascertain whether you are, in fact, based in the UK as laws in other places are different.

"Real estate" is an American term and few of us on here are at all conversant with American law. Since you are here, the advice stands. We have had posters based in the US/Canada and other countries show up here so it is a valid question.

Apologies for any misunderstanding or offence; none was intended, I'm sure.

I doubt anything bad was meant, they were just trying to figure out if you were in another country as Real Estate Agent isnt a term used in UK. I expect they didnt want to offer you advise that wasnt relevant to where you were living.

Now its clear you are talking about a england deposit Im sure you will get the help you are looking for

    best of luck
