"BUT the only thing the estate agents said is, check he will still receive his benefits as it's non residence"

Must be a mobile home or chalet on a site, which is not registered as residential. These have the 11 month letting period limitation.

With these sites, you cannot receive Royal Mail postal deliveries and have to provide a different correspondence address.

This should be entered as non standard Housing under Universal Credit and they would only include Housing for the relevant period. The documents supplied would need to state the month time period, where the home was not going to be occupied.
The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

Benefits aside. As your brother has autism would the moving out for a month every year not be upsetting for him.

I personally would avoid this and find somewhere he can make his long term home.

the estate agents said he can only live their 11 months of the year as the owners want to go back for 1 month of the year, which is fine as he can just go back to my mums for 4 weeks.

No, it's not fine. There are way too many cans of worms there. You are setting yourself up for a whole host of complications when it would be simpler to just find a property he can use as a permanent residence.

Our static caravan is on a holiday site where we can only stay there between mid-January and 1st March, with limited daily access of a couple of hours for maintenance purposes, during the 6 closed weeks.

I knew someone who chose to live in her caravan, on the same site, renting a flat, nearby during closure. She is no longer there and probably due to the rule, added sometime later, that states neither owners nor others may stay for more than 4 consecutive weeks.

Would there be danger of this change being made to the mentioned odd rental ?

If the EA mentioned 'not residential' it may be that the accommodation is in an area designated to be for very short lets only and should the authorities discover someone staying longer, it could lead to eviction.

Some time ago, a member on here was asking about buying a, cheap for the town, house in a limited occupation area ( meant for holidaymakers) and ignoring the rule, but they were advised that it was not worth the risk, if found out.

In addition to it never feeling like home because he'll need to move out for a month, and the other concerns raised above, it doesn't sound as though the owners/estate agents are being straight with him if they're saying it's because they want to live there for a month. Walk away and find a standard let would be my advice
