Court Summons Received - ignored all previous letters - what now?

    here is what Umkomaas has already posted on this forum


    £100 - original parking charge
    £25 - court filing fee
    £25 - hearing fee, if it gets that far
    £7 or £8 interest.
    £50 - solicitor costs for preparing case papers (maximum, capped) - where applicable

    So not much more than £200 - IF YOU LOSE!

    Anything else they try to add will be spurious and must be challenged with the Judge.

    IF YOU WIN - none of the above will be payable by you. But you could claim:

    £95 capped maximum for loss of earnings/annual leave for half a day (take pay slips for proof)
    Travel costs - public transport or mileage x 45p per mile
    Parking costs.

    If the PPC has been wholly unreasonable in dealing with the court, then costs awarded against them could be considerably more, but the bar is set very high. We would advise nearer the time if we think this is worth you pursuing.
    it seems to me there is some £60 to £81 spurious charges in there


    a typical ParkingEye figure is about £175 in total

    Hi all - in the POC they are only claiming £180.58 outstanding debt and damages. to the right of the POC there are additional fees of £25 court fee & £50 legal reps costs (=£255.58)
    Are these legitimate court fees?

    The court fees are legitimate but the £180.58 may not be. How do they arrive at that figure?

    But the POC is along the lines of:

    "Outstanding debt and damages ref71XXXXX...

    Total due 170.00

    Claimant claims 180.58 outstanding debt and damages including 10.58 interest pursuant to S.69 of the country courts act 1984 Rate 8% pa from dates above to and so on....
    Same rate to judgment or sooner. Daily rate of 0.04.

    I will provide defendant with separate particulars within 14 days after service of the claim form."

    the original charge as seen on the signs and the NTK is probably £100 , so that is the outstanding alleged debt , the other £80.58 is probably about £60 in DEBT COLLECTION additions , plus that INTEREST, plus wherever they added another £20 , its make it up as you go along time

    and have you emailed a SAR to the DPO at CEL for copies of all docs , pics and data ? attaching a copy of the N1 claim form or V5C as proof of ID under GDPR yet ? if not , do so asap

    I note that it was on a day I went to the dentist and when I came out my other half and 3 year old were there and it was her birthday. I walked home & forgot about the car - so parked for 3hr 45m in a 2 hr limit - has this any relevance?
