Marks and Spencer MasterCard credit card

I paid for Thomas Cook flights using M & S Credit Card. When I tried to claim under Section 75 M & S insisted I claimed using the “charge back” scheme. They said that I should allow 60 days for response and if declined only then can I claim under Section 75. Are they giving me the correct information? Surely they are delaying the refund that I am legally entitled to? Can anyone advise please?

  • They're surely not.

    Chargeback is likely to be quicker and more straightforward all round if they're acting quickly. Leave it with them.

    I believe from the replies to other threads that chargeback is the correct procedure.
    The 60 day wait for a response seems a bit mean though. I wouldn't have thought that it should be taking them that long.

    S75 usually means they are funding the refund themselves and chargeback means it's the company or (in this case) their bank that is.

    You can imagine which your card issuer prefers.

  • It can be either. A chargeback can done on a credit card.

    No. Chargebacks work on both Debit & Credit.

    The timescale to contest is 45 days. But card providers add a extra few days on. As you can imagine in cases like T/C the volume is massive and it is better to give some extra leeway.
