Digital product - am I within my rights to request a chargeback?

    It is difficult to be absolutely sure. You purchased some in-game resources in the expectation that they would be protected. Presumably you have checked with the user manual that your understanding is correct. They were not protected but were looted, so on the face of it you might have a case in that they did not apply the protection they promised and thus misrepresented the situation regarding your purchase ie you would not have bought the resources if there was no protection.

    On the other hand, the game is an environment where it seems the whole point is to loot each other's resources!

    If you do choose to pursue this, you should really concentrate on the misrepresentation angle, but I think you might have an uphill struggle.

    How much are we talking about - is titanium expensive???

  • Thanks 18cc. That is much more constructive. I think the length of my original post has lost the important point that you picked up on.

    I expected to be able to use what I had paid for (the ship). I can't, as I can no longer build it.... without paying more, lol...

    They offer a level of protection that in this case fell below the level that they state would be provided.

    I also was lead to believe that what I bought would be given tokens that can't be stolen, that I choose to redeem at a later date. What was in fact provided was a combination of the two, and I only discovered this after I paid ��. A small number of tokens and a larger number of already redeemed resources.

    Tritanium is not expensive persay - it's time consuming. Or loot from other people.

    Its the first time ive paid for this service and it is certainly not what I expected. It was inadequate, putting it mildly.

    This would seem to be like trying to get a refund for concert tickets because you were unable to attend due to being stuck in a traffic jam.

    You could try appealing to the game people, as they have a vested interest in you continuing. However everyone could do that every time they lost stuff. So I wouldn't hold out too much hope.

    Hello, I don't think you a have a chargeback claim because you received the items. I'm sure if you speak with the game developers they will try to help you out.

    You could try contacting Apple \ Google Play about it, but I don't think you're going to get anywhere with it. It's the case that the item was delivered, you got what you paid for, and you seem to be complaining now about gameplay mechanics that encourage "stealing" of your "resources". You said :

    But that's not the case right now and you paid for these on the basis of that knowledge.

    I wish you luck, but honestly I don't think you've got a leg to stand on with this.

    I would agree with all the above post saying there is no no case for a chargeback but for the fact that there seems to be some disagreement about the level of protection applied to the purchases which might result in a misrepresentation

    I can't really think of a good analogy but what springs to mind is that you buy some Amazon gift cards and when you buy them you are told they won't expire for 24 months and when you come to use them two weeks later they have expired - yes you could argue you have received the gift cards and thus no chargeback possible but equally there is misrepresentation there because you wouldn't have bought them if you knew they expired so quickly

    not the best analogy but it's all I can think of
  • No, and if you said these weren’t authorised your bank would be stupid to believe that as well.
  • I mention this because the important factor to note is that a player's station, or base, can be attacked and looted by other players. These basic materials (not the advanced) can be looted during such attacks
    i believe that the resources I have paid money for should be treated differently to the resources that I've obtained for free. For example, they could have a grace period during which time they cannot be looted, in order to give adequate time with which their customer can actually enjoy their purchase.
    In one of the above paragraphs you say that the advanced materials (I'm presuming these are the purchased ones) cannot be looted. In the other paragraph you say you believe purchased resources should be treated differently. What do the games T&Cs say about it?

    So, did you purchase something by card that had a documented guarantee of immunity from looting? Does the game guarantee that you will receive notification of 'attack' or just that notifications will be sent? If you'd got timely notifications of attack would it have made any difference to you, given that you had lost your internet connection?

    It's not looking good for your claim at the moment.

    Another thought regarding these notifications of attack and the loss of internet connection.
    If I understand things correctly, these attacks could come at any time. Does that mean that you have to be ready to respond to such a notification at any time. 24 hours a day, 7 days a week, 365 days a year?
    If not, what is the difference between this (highly convenient for the attacker) loss of internet connection or your being in bed asleep or out shopping or otherwise unable to immediately respond?
