  • Is it worth me doing a SAR now?
What happened if they don't get back to me?

thank you for all your help guys.
This is stressing me out and am tempted to just cough up to get it finished with now.
Though that would really P me off.

This is stressing me out and am tempted to just cough up to get it finished with now.

If you do, according to a recent statement by an MP in the House of Commons, you might probably be contributing to the coffers of organised crime. If Gina Miiler finds out you could be in trouble.
You never know how far you can go until you go too far.

Yes, submit a SAR as the info it provides might be useful at witness statement stage. PPCs have 30 days to respond to a SAR.
  • please can someone help with the procedure for a SAR?

i.e who I send it to and by what method.
and what exactly do I ask for?

I can't find the thread where I saw this listed earlier.

    Thanks a lot!

That info is in post #2 of the NEWBIES thread.

There's a link to the NEWBIES thread in my earlier post.

OK so sent a SAR to Minster Baywatch asking for:

I require from you with reference to the claim:
    ALL PHOTOS TAKEN
    ALL LETTERS/EMAILS SENT
    ALL DATA HELD
ALL EVIDENCE YOU WILL BE RELYING ON IN COURT
A FULL COPY OF THE PCN/Notice to Keeper
ANY ANPR VEHICLE DATA YOU MAY HOLD ON MY VEHICLE
FULL DETAILS OF ‘THE CONTRACT’ AND RELEVANT SIGNAGE
A COPY OF YOUR PRIVACY POLICY
    EVIDENCE OF LANDOWNER AUTHORITY
DETAILS OF ANY THIRD PARTIES YOU MAY HAVE SHARED MY DATA WITH

Minster Baywatch replied within a day.... and sent:
    6 photos of the car
Notice to keeper letter dated 26/03/19 (isn't there a time limit for this from date of contravention?)
Demand for payment letter dated 24/04/19
a subject access request letter which shows when they went to the DVLA for vehicle details (26/03/19)

There was nothing else sent i.e
no photos of any signage/ details of any contract.
no copy of the original PCN
no copy of their privacy policy
    no evidence of landowner authority

My defence deadline is fast approaching (mon 4pm) so any thoughts about the results of this SAR please?

Should I stick with my defence as above and keep it brief or does it need adding to?
I understand I have to mention everything now that I will be expanding on later at the WS stage and provide photos etc. later.

Thanks a lot for your help.

Can't believe how busy this forum is. These companies must be making huge amounts of money. Willing to fight back.

Three of those four 'missing' items are not your personal data and therefore the SAR recipient is under no obligation to supply them in response to a SAR.

They should however have supplied you with a copy of the original PCN.

Do not miss your Defence filing date:
...you have until 4pm on Monday 7th October 2019 to file your Defence.
  • thanks Keith, so should I mention the lack of complying with the SAR in the defence?

and is the defence drafted above OK?

    thanks a lot
  • I am obviously going down the route of inadequate/ insufficient/ poo placing etc. of signage and lack of entry into any contract. The car park is free so I assumed I could park for free.
