I took out a mobile phone contract in my name for my friend who I was helping out during a bad time. It was nothing major, however I changed banks and my Direct Debit didn't get switched over.
Subsequently the phone was restricted to incoming calls only and they called the mobile number as I owed them 2 months payment which isn't an issue, I will pay it tomorrow, however they rang the mobile number and told my friend that I owed them money, they didn't give any of my info out as such apart from my full name as they asked whether "(My full name) was available" but then they did tell my friend they needed to speak to me "because I owed them two invoices totalling £50". This was after my friend told them I was not available on this number.
My friend gave them my actual number and they called me and we've sorted it but he seems to think that they are not allowed to tell him what they did, is he right? Have they broken data protection rules?

You have two phone contracts under the name Mezzor?
You owed money on one, so they phone the other phone in your name?
I don't think that there is anything wrong. Otherwise everyone would just pretend to be someone else to get out of paying. They called a phone number which is your phone number.0 -

Yes I have one contract with Vodafone and one with EE both in my name, one mobile is mine, the other my best mates, the one with the issue is the one my friend uses. All in my name, paid by me.0 -
So you didnt pay your contract (that your friend uses) so they rang the phone that hadnt been paid for and spoke to the person who answered?
I doubt you'll get anywhere, plus fines for breaching GDPR don't go to you anyway, just leave it, and pay your bill in future.
Surely you friend knew something was up anyway as he couldnt use his phone to call people? Not as if they told him anything he couldnt work out with an ounce of common sense.0 -

I'd sue the friend for giving out the other number without my permission, an obvious breach of GDPR.0 -

Technically yes it's a breach if they knew they weren't speaking to their customer - but would the arrears have been sorted as quickly if they hadn't told your friend why they were calling?0

I think its more 'you are entitled to nothing' as a result of a GDPR breach unless you can provide evidence of a quantifiable loss. You 'might' get a small gesture of goodwill. In the case of the Op, i doubt they would get anything. Its up to you to ensure all direct debits transfer over correctly not the company the direct debit is with.
Plus as far as the company were concerned, the contract is in your name, your phone, your responsibility. You would struggle to argue the company were not being unreasonable to assume when they dialed the number, that the person on the end of the phone was the person / connected party of the person who owned the contract. When someone rings up chasing for money, a lotbof people's response is to deny they are that person being chased.May you find your sister soon Helli.
