Restocking fee for uncollected electrical goods

Hello MSE community,
I am looking for some advice regarding a recent purchase which I no longer require as I stumbled upon a better model. The item in question is an MP3 player.
My purchase was made at a Sony Centre just over 2 weeks ago in person. The item was not in stock and so they had to order a unit in and I would then go and collect once arrived. I received a voicemail a few days ago to say it was ready for collection but as you know now I don't have any use for it.
The retailer is saying I will incur a 15% charge as they are a special order item. There is no reference to this on my receipt and normally I would understand but I haven't even seen the box let alone opened it.
Any suggestions? I know because I purchased the item in store I don't have nearly as much protection for this purchase as an online order but 15% is well over £100 and I don't believe this to be allowed.
Thanks very much in advance.

Hi
You haven't got any rights to a refund - as you bought in store - so buy it & sell on ebay etc or take the refund less 15%.

You have absolutely no right to return this item because of change of mind and the retailer have every right to charge you what they see fit to take it back off your hands.0

£700 MP3 player ?0

Why not? You obviously know about the distinction between distance and non-distance sales - you may as well take the 85% when you're only legally entitled to 0%.gmatharu1221 wrote: »I don't believe this to be allowed.0 -
We take it you paid upfront on order then?Life in the slow lane0

Thanks for the input everyone. I did not expect this to be fair. I have always seen with retailers (electronical stores included) in the past have terms that say you can refund the item as long as it's unused/sealed but okay point taken. Cheers again.0

Thanks again to all. I decided to take the 15% hit. They are a special item, serial numbered and they weren't able to wavier on this restocking fee from Sony Japan.0
