BW LEGAL / Premier Parking

Hello all, my first time posting, I need some help.

My wife and I went to local pub in 2016, like always, parked as always (signs up but you didn't need a permit for the pub). We decided to leave the car overnight.

We got a ticket the following morning.

We missed the appeal process as the notice to keeper went to our old address (we moved a week or so before).

Parking is free overnight for customers but have noticed the pub signs say that you have to have a permit for the overnight (this is seperate to the main signage).

We have tried to explain to BW LEGAL and offered to evidence we were patrons of the Pub, they ingore that.

Received a claim, how should we defend?

I am looking for some help firstly with the fact we didn't have a permit, primarily because we never needed one before and the signage is supplementary.

I am confident that the setup is confusing (as it confused us), we didn't even see the permit on the second sign and I am certain we should have qualified for free parking in either event as we were paying customers of the pub.

    First complain to the pub, locally or if that fails, head office. What stage are you at? Just the PCN with debt collector letters or have you received a LOC/LBC/LBA?
  • If you can evidence that you were paying customers, that would be helpful when you contact the pub.

    Whose sign was the one indicating an overnight permit was required, the pub's or the parking company's?

    There are many websites advertising pubs, plus facebook and TripAdviser on which you can vent your displeasure if the pub does not cancel this.

    Nine times out of ten of these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies

    There is no such company. Fed up with posters so often calling them that!

    Can you edit your thread title please, for when you come back when you get the inevitable court claim? It will save confusion if you put the right PPC name in full.
