  • Geoff, the court would or would not award costs to the claimant or their representative, nothing to do with what the insurance company agree to. If the matter doesn't reach court, and is settled, then the insurance company and solicitor could agree costs separately. If it's an open/shut case, then £250 wouldn't be implausible for a junior solicitor to deal with the claim. Depends if the legal company are any good. I'm a trade union member and if I had to put in a personal injury claim the union's solicitor of choice does not take any of the compensation paid out.

    Nobody here can know as we do not have access to the full reports. One thing is for sure, your NWNF lawyer will be taking a chunk of your settlement.

    It does sound as if you also have emotional issues due to the accident as well the physical discomforts. These things can be very unsettling. Hopefully you are receiving some help with this.

  • In the past I used to be fairly cynical about rear ending compo claims. I used to work for an insurance company and some of the blatant baloney about whiplash and psychological effects turned me into a yeh yeh blah blah not interested kind of person.


    Last year however I had the misfortune to be shunted up the rear by a driver who came around the corner too quickly. I saw him coming and literally had no where to go as I was stopped in busy traffic. To this day it still freaks me out. I used to be a confident driver. Not any more. Driving on motorways freaks me out. Driving in fast traffic freaks me out. Drivers braking for no reason freaks me out. I worry every week about the hour commute to and from my weekend place and having to use 3 horrid motorways in rush hour (61, 6 and 55). My partner hates taking me as a passenger because I'm always tensing and grabbing hold of the grab handle. I've never been the same since the accident and put it down to that entirely which I think is crazy given I was stationery and he was going about 35. I feel like I'm being ridiculous. I keep telling myself it wasn't like I was going 70mph and was rear ended on the motorway but it makes no difference.


    I wish I could offer some advice but I chose not to pursue an injury claim myself and just got my car repaired but I wanted to say I do feel for you and I hope you get it all sorted.

    You're far too early to think about a figure. You could have medicals, assessments, counselling etc before you get to a settlement.
