UKCPM Gladestones letter

I have read the newbies thread and it is very helpful, however I did this only too late.
DO NOT START SCRAWLING A HALF-BAKED 'DEFENCE' ON THE PAPERWORK. STOP!

Unfortunately I have recently sent this off before viewing this thread, in reply to a gladstones solicitors written letter.

I am struggling to understand now where I am within this process. I have appealed in writing multiple times.

I know they are a IPC AOS company so have viewed this route, does anyone have any advice on what/where I can go from here?
(I have also requested a SAR as of reading the mega thread)

Thanks,

What have you said, to whom and in response to what? Was it a PCN, debt collector letter, a LOC/LBC/LBA/LBCC or formal court papers?

Have you received a formal 'Letter of Claim' from Gladstones?

Have you received court papers from the Northampton CCBC? If not, a formal Defence is not yet required.
I have appealed in writing multiple times.
Once is all that's required, sending more and further appeals, just gets you the same number of rejections in return. :wall:

  • I believe it was a claim form? It was titled as such and had Gladstones address and info on it. Noted; County court business centre. It also has amount claimed: Court fee: Legal representatives costs:

I reiterated my defence from before, they even have pictures of my permit in the footwell of my car, but it is not 100% visible. Also stating that I had no other infractions during my time of staying there which was over a year. I did however say I would pay a reduced price (as I was worried at a time before reading this that it would just increase and I'd have a CCJ) Of which I know better now.

I believe this is what I have received...

If it is a genuine LOC it should give you 30 days to respond, would normally include financial forms (which of course you don't fill in) and should have their particulars of claim with evidence that they are going to rely on in court. If it is all of those you need to go the NEWBIE sticky post # 2 and follow the instructions there, starting with submitting a SAR to the PPC.

Unless you marked that offer 'Without Prejudice, Save as to Costs', it is likely to be presented in court as a tacit admission of culpability. Not your finest move.

  • Hi all,

It had these forms within it, and allowed me to select acknowledgement of service which allowed 28 days. However the rest and asking for payment gave 14 days for payment. Is this a genuine LOC (something something claim)?
starting with submitting a SAR to the PPC.
I have done so in order to review their information.

I see that now, where do you think I should take this now? As in I've replied shall I just await their correspondence or is there more I can do?

    Thanks in advance.

They are extremely unlikely to accept any lower offer. What amount are they currently seeking and how is it broken down?

From that it is clear that you received a County Court Claim Form from the County Court Business Centre in Northampton.

Please post below the exact text that you submitted as your Defence.
Not just 'something like...', but the exact text that you sent.
  • Thanks
What amount are they currently seeking and how is it broken down?

    Amount claimed: 174.50
    Court fee: 25
    Legal rep fees: 50
    Total: 249.50

From that it is clear that you received a County Court Claim Form from the County Court Business Centre in Northampton.
Which step is this outlined in the newbs guide or has it surpassed this being able to advise me?
Please post below the exact text that you submitted as your Defence.
Naively it was hastily written and was effectively in further detail what I wrote in the 'something like' comment beforehand. I understand this was stupid and has not helped my case at all. Is there anything I can do?

    Thanks all!

Are you really saying that you didn't keep a copy of the Defence that you filed with the County Court Business Centre? Yes or no.

You need a copy of that Defence.

Phone the CCBC and ask them to email you a copy of your Defence.
The CCBC's phone number is on the front of your Claim Form. Do you still have your Claim Form, don't you? If not, google County Court Business Centre for their phone number.
