selling my home

I bought my house 30 years ago leasehold I then bought the Freehold I believed all was in order and am now selling the property. I have been told by the purchaser's Solicitor that my Title is defective as the Head lease was not registered. Land register shows Underlease and Freehold. I have all the documents the head lease originally contained 6 houses there are now only 3 on it. My Solicitor offered an indemnity policy but Purchaser's Solicitor adamantly says "No" The lady who originally owned the Head lease passed away in 1967 The owners of the original freeholds are a very large estate. The ground rents for the properties left on the Head lease are collected by a neighbour and then paid to the estate. I have collated so much info but no one seems to know what to do next and am just being told can't sell property as it is not registered correctly. Can anyone tell me what to do next really thought Solicitors could have sorted it out!

    Who inherrited the head lease in 1967?
  • My neighbour who's house is still on the head lease and she collects the ground rents for the other 2 properties and then pays them to the estate. After buying my Freehold she received instruction not to collect ground rent from me. She advised me that whoever lives in her house holds the Head lease

    then why not invite her to tea, bake a nice cake, and pursuade her to register her Head Lease?
  • Is it that easy? why haven't the Solicitors advised this? Would that then mean I could merge all 3 titles and proceed? thank you

    My advice is based on the information you have provided. If she is reluctant, you might need/want to offer to pay her associated legal/Land Registry costs......

    As is - no. Because somebody else holds the Headlease for your plot.

    Remember, three hats.
    Freeholder
    Headleaseholder
    Leaseholder

    You can wear the first and last hats, but somebody else wears the middle one. You cannot merge them without the agreement of every hat-wearer.
