Selling house (unregistered land)

I'm looking to sell my house soon. I bought it before registration with the Land Registry was required so there should just be a bundle of Deeds with my Building Society.

Should I budget for any extra expense or delay?

    Why not register it now before you put it up for sale?

    Just get it registered now. If you don't it'll slow things down (at greater cost) when a solicitor eventually says "not registered" and they drag down the speed of conveyancing.

    Because I don't know if it's a trivial, quick, cheap and easy task suitable for an amatuer :j OR an expensive time-consuming nightmare :mad: OR totally unnecessary:) OR £100/1 hour extra to a solicitor.:)

    You can do it yourself, but it's bread-and-butter for a solicitor. We registered our previously-unregistered house after the sale was completed, cost £270 for a first registration and our solicitors did it all in the background.

    As there's a mortgage, a solicitor will be required to register the Building Society's Charge.
  • Also, as you have the original deeds, albeit with the Building Society, do request that they are returned to you after the registration process. Please do not get fobbed off the statement "don't need them anymore, everything is electronic".

    Personally, I would photocopy/scan everything in the pack...

    Curious as to the reasons for holding on to the original deeds of a house I'll have just sold?

    So you can give them to the new owner?

    They're usually interesting (if not useful) documents that would otherwise just end up being shredded. Think about the historical preservation aspect - once they're gone they're gone forever.

    You can sell as it stands I.e. unregistered - your solicitor prepares what is known as an Epitome of Title and sends this with photocopies of your Title Deeds and the Contract and protocol forms. Then the solicitor acting for your buyer will do a first registration OR as others have said you can do a voluntary first registration with the land registry. You won't keep the deeds after the sale. They'll go to your new buyer. Timescale is an issue for first registrations so I'd speak to the land registry about timescale if you are thinking of doing a voluntary first registration

    :T (Penny drops) Reading your reply and what Ithaca said, I'm seeing that it need not hold up anything because any delays (at, say, the Land Registry) will be after completion when no one is particularly worried. :)
