Got my 1st CCBC Claim from Gladstone - Please Help
Comments
-
Good morning Guys,
At this stage, I got the confirmation that my defence was received. I have also received the answer for my SAR request from Gladstones and it seems that they only have the LBC, the Claim Form in CCBC, my Acknowledgement and my Defence; nothing else.
The Claimant, Pace Recovery & Storage, refused to send the information about me saying 'Thank you for your request. I will need to see something that proves your identity, such as a copy of your driving licence, before I can release any information.'
What is the best thing to do? Should I send them my Driving L. or should I insist they must release the info without any other data from my side?
Thank you!0 -
Do not send your driving licence, they don't have a photo of you to compare it to. Send a copy of your V5C and a copy of the paperwork they sent you. If they still don't play ball, a complaint to the ICO is in order.0

Just an update.
I have received the confirmation that they received my defence ('I acknowledge receipt of your defence. A copy is being served on the claimant (or the claimant's solicitor). The claimant may contact you direct to attempt to resolve any dispute. If the dispute cannot be resolved informally, the claimant will inform the court that he wishes to proceed. The court will then inform you of what will happen.
Where he wishes to proceed, the claimant must contact the court within 28 days after receiving a copy of your defence. After that period has elapsed, the claim will be stayed. The only action the claimant can then take will be to apply to a judge for an order lifting the stay.')
Nothing has happened for the last 20 days. Is this a usual approach from their side?
I will keep you updated!
Thank you for your help!0 -
Just be patient and wait
In the meantime , sort out your DQ research , if necessary download it and fill it in ready for submission to the CCBC
Stop speculating , you are not the only claim they are dealing with and this process will grind on slowly
The longer it takes , the more likely you will receive the reply to your SAR , which is the most important part , apart from the DQ0 -
Update:
I have received an email from Gladstones saying this:
'We act for the Claimant and have notified the Court of the Claimant’s intention to proceed with the Claim.
Please find enclosed a copy of the Claimant’s completed Directions Questionnaire, which has also been filed with the Court.
You will note the Claimant has elected to mediate in an attempt to settle this matter amicably, without the need for further Court intervention. Should you agree to mediation, please inform the Court who will contact both parties to arrange a mediation appointment.
Yours sincerely,'
There is also of their DQ attached.
I believe I need to wait for an official letter from the Court, right?
Any helpful thoughts at this stage?
PS: the funny thing is that I went yesterday to that car park just to take some photos for my future witness statement...and guess what...they have populated every corner and every lighting pole with tens of signs. The good news is that I have the video and the pictures with no signs(taken a month ago). Ha Ha!0 -
My helpful thought is read my previous reply and read the newbies thread post 2 again
I already told you what you are waiting for , or alternatively download it , fill it in and email it to the CCBC and the claimant and Gladrags
This is getting tedious , like talking to a brick wall , do the research and be proactive , not reactive
At least you have old pictures and new ones , showing the changes , so the only useful info from your post above0 -
That is very good, you can compare and contrast, at the hearing, and ask in the WS whether the changes were due to the PPC failing an ATA or DVLA audit on signage and having to address the problems, or whether the changes were due to complaints to the landowner, from victims caught by the entrapment lack of signs.the funny thing is that I went yesterday to that car park just to take some photos for my future witness statement...and guess what...they have populated every corner and every lighting pole with tens of signs. The good news is that I have the video and the pictures with no signs(taken a month ago). Ha Ha!
Which was it, you need to ask. Put them on the spot at WS stage and at trial.
