First of all I know reclaiming charges is on hold until the test case.
Ive just received a letter from my bank (halifax) they are taking £39 from me for a failed item, a £26 cheque!
Its my fault, I completely overlooked this but I thought most had lowered their charges and it annoys me that the charge is more than the cheque.
As im on Income Support I was thinking of writing a letter to the bank, I really dont want to lose £39 just before christmas :mad: Do you think it will help? Should I mention in the letter about court action for when the test case is over, Its only the second charge ive ever had on this account in over 10 years so should I mention Ill claim the other one back too?? or does it make me sound abit cocky?

I did a similar thing but still got a holding letter back. I think they always send a standard reply as soon as they see the word 'charge'.
Try calling them, as if you do it in writing I think you'll have to send at least 2 letters. One to get the holding letter & the next to make them actually read you letter."A bank* is a place where they lend you an umbrella in fair weather and ask for it back when it begins to rain."
(*Unless it's Santander. The branch says they sent you an umbrella 3 times already and don't understand why you don't have it yet and want it back right now!!!)0 -

It's usually best to phone up in the first instance and ask if they will reverse the charge. If it's the only one and otherwise your account has been run well, they should do it.
Credit card charges have been reduced, but not bank charges. Hence why your charge is more than the breach.0 -

i had a bank charge last month for the first time with halifax so i phoned them and they said as it was my first time they wouldn't take the charge, so i would try phoning themMarried 09/09/090

me too, i just got a letter for a £39 fine, i missed the DD by a few hrs, but got the money in there the same day.. anyway, seeing as i am trying to claim the last 6yrs of charges all back at the mo, and i am just getting standard letters from them, i will be added this to the total.. but i sent them a without prejudice letter saying that if the paid out before xmas, i would accept £900, no news from them yet, but if they get stroppy, i will try to claim back every charge plus interest... bleeding modern day pirates are getting away with it too much.... hope we can all screw them rotten....if not, at least we know that we gave it a bleeding good try.....;)Corduroy pillows are making headlines!
