  • Bailiffs can ONLY be instructed if a CCJ is in place, no CCJ, no bailiffs.

    Anyone else asking for money are simply debt collectors with no powers at all.

    Anyone expecting bailiffs should keep their doors locked and not let them in. That would be the end of their powers.

    ok brilliant. One last thing if get a letter and use the CML guidelines and they dont accept it would that be me confirming in writing that its my debt?? i will leave you in piece now thank you for all your advice today you've been a real help. Would it be ok to keep this thread open so i can message back if i receive any letters in near future??

  • CML guidlines are that within 6 years of the property sale the lender did not attempt to contact you, at an address that they could prove you lived at at the time of contact.

    You making an acknowledgement in writing is of no consequence for you within the CML guidelines but it WOULD start the 12 year limitation Act clock ticking again.

    Safest thing is only do things on the phone, a phone call can never be acknowledgement for the Limitations Act.

    I am probably looking to far into this situation now but if the cml guidelines are 6 years why does the 12 years matter any more??
    And if natwest have passed on the debt which they more than likely will have done will this new place still have to abide by all this??

    Thanks for your PM. I have previously explained the difference between CML and Limitations Act, please read back through your thread.

    Your head is wurring round and round, and it needs to stop for your own good.

    Start concentrating on your letter box instead, what ever pops through there will decide your next step.

    If something pops through the letter box get back in touch, with your bankruptcy option you always remain in control.
