  • I definitely wont deny that I just dont really know what to do for the best and want it done and behind me so I can move on. What would you suggest me doing then?? Also how do I know for sure no court action has been already done?? I mean the paperwork would have gone to the property I left and I never went back for the post
  • I'm just bricking it that I could do that and this other guy that was on the mortgage has made contact and would then screw me with the stat barred
  • You could give Northampton County Court a ring, they process nearly all the money claims for the Country.

    go through each section and if there is nothing showing its dropped off your records. It also shows CCJs.

    Any letters received send the statute barred letter, someone will link to the template, as bills / loans / credit cards have 6 year limitation to take any action. The shortfall on the mortgage has 12 year limitation.
    Mortgage started 2020, aiming to clear 31/12/2029.
  • For joint debts, a written acknowledgement re starts the debt for that person only - a payment re starts the clock for both parties.
    Why not wait a bit to see if you receive any contact - 3 months say? - It won't take away your bankruptcy option.

  • I have done the MSE credit club and apart from my two bank accounts on there that have no over drafts just my own money going in and going out it's as clean as a whistle nothing about any debts or CCJs but I will also check the other two in a minute.

    I know you have already said it but I just want to make sure as above you have put the mortgage shortfall is 12 years when does this point actually start?? Also say if its 10/11 years I can still say I wont be paying under the CML guidelines?? Even if its be passed on from natwest and some other company is dealing with it??

    I have just done the clear score and the credit karma and both are fine neither say anything about ccjs (would it still show on there even if it was filed say 8 years ago??) im guessing this is good ish news.
    the credit karma one is the only one that shows a financial connection to the lad i brought the property with which was dated in 2006.
    Theres just so many what ifs with the whole situation that makes it scary

    For the Limitations Act it is 12 years from the sale of the property and that in that time YOU have not acknowledged the debt in writing and NEITHER party has made a payment of any kind and no court action has taken place.

    CML guidlines are that within 6 years of the property sale the lender did not attempt to contact you, at an address that they could prove you lived at at the time of contact.

    I think 3 months wait and see could be the deal breaker here. It takes nothing from you, but could provide you a solution without all of the implications of bankruptcy.

    ok so because there hasn't been any court action already there cant be any now beens its over 6 years?? If i ring Northampton county court will they tell me if i ever had one or is it definitive that cause my credit reports don't say anything about ccjs there isn't one and never has been one??
    On seeing when i was linked with the other buyer of the house, i feel like i have rough dates. We moved in around 2006 and walked away in summer ish of 2009 so i feel like i would be a couple of years away from the 12 but couldn't be sure. So with that in mind i would have a cause to say i'm not paying due to the CML guidelines??

    i feel like i'm leaning towards the waiting 3 months and see what happens i've got nothing to lose but a lot more to gain i am just worried that i could get a knock on the door and lose my stuff
