Is person on Council Tax Support liable to pay other tenants Council Tax?

Is person who is on Council Tax Support (CTS) liable to pay Council Tax of another person (the other person lives in the same property)? The Council sent to the person having CTS a summons. No prior correspondence occurred with that person. They just sent to the person having CTS the summons without any explanation why.

Before that occurred the other person who has not paid the Council Tax shown on the bill has appealed the Council's decision and the amount on the bill, and the appeal is still ongoing.

It does not seem fair that they want a person being on CTS to pay Council Tax of another person. Being on CTS means that that person cannot afford to pay Council Tax, and yet they want that person who cannot afford to pay her own Council Tax to pay Council Tax for someone else! It does not make any sense, it seems illogical.

Is there any way to do something about this?

    A person on council tax support remains jointly liable if they are found so under council tax legislation - council tax support gives no special position when it comes to payment of council tax and joint liability.

    Providing that both parties fells liable under s6 of the local government finance act 1992 then the surviving party remains liable, regardless of any council tax support.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    Providing that both parties fells liable under s6 of the local government finance act 1992 then the surviving party remains liable, regardless of any council tax support.

    So in theory the person unable to pay, will get a bailiffs visit and additional costs - both of which are difficult to pay.

    Can the person due to pay the debt opt for attachment to benefits to avoid bailiff fees.

    The council may allow it, they don't have to.
