Quick question ref Notice

It looks like we will have to give notice on our rental property and I just want to double check the timings please - I have read the stickies but am still a little confused....

Our tenancy start date is the 28th and this is the date that we pay rent each month also, we are on a rolling contract after our fixed term ended a couple of years ago so we are required to give one months notice.

We are on good terms with our LL so I asked the question and was told that the notice would have to be given on the tenancy date (so the 28th) however my impression from reading the sticky here is that it should in fact be before that, ie the 27th or earlier.

We are hoping to give notice this month, so if we gave it on the 27th September, would that be correct? And if so, when would we then have to leave? Would it be the 27th October - before the next rental period starts and payment falls due?

The more I have read, the more I have confused myself!

    Yes.
    28th = first day of month.
    27th = last day of month.

    Your notice must have been submitted by the first day of a month to be valid for that month, with your tenancy ending on the last day of the month.
  • To give an example of what we just did in a similar situation:

    Our rent has always been paid on the 13th of the month. We handed our notice in on 12th August, paid our last rent payment on 13th August and had to be out by end of play on 12th September, thus avoiding any disputes over paying rent for only part of a month.

    If your contract started on the 28th then you should give notice on the 27th. That way there is no argument to be had.

    However, there is nothing to stop you giving notice before the 27th, rather than waiting until the very last day.

    In fact you can serve notice on or before either the 1st, or last, day of a period (ie on or before 27th or 28th), in order for your tenancy to end on the 27th of the following month.

    Bear in mind 'service' of notice is the date you hand deliver, or 2 working days after posting 1st class.

    However as many landlords/agents do not know this, using the 27th might avoid any argument.

    Additionally of course, if you have a good relationship with the LL, there is nothing to stop you agreeing a shorter notice period, or a different end date, providing you both agree. In that case, make sure it's confirmed in writing.

    * Ending/renewing an AST: what happens when a fixed term ends? How can a LL or tenant end a tenancy? What is a periodic tenancy?
  • Or maybe make it clear in your notice that you know you're required to give at least 1 full months notice.

    We are currently serving our notice which was sent to our landlord about 10 days into our rolling 1 month period. This gave us and the landlord the remainder of the month plus a full month on top for us to do some work on our new home and for the landlord to find new tenants.
